Lowe’s has for years advertised certain products with perpetual false discounts in an effort to trick consumers into thinking the products are worth more than they truly are, a new class action lawsuit alleges.
Plaintiff Michael Hern’s class action lawsuit claims the “massive and consistent” false discount advertising scheme affects consumers both shopping in Lowe’s retail stores and on its website.
“Lowe’s’ deceptive pricing scheme is intended to trick consumers into believing that its Products are worth, and have a market value equal to, the inflated list price, and that the lower advertised sale price represents a special bargain,” the Lowe’s class action says.
Hern wants to represent a class of consumers who, during the applicable statute of limitations period, bought one more product from a Lowe’s in the state of Washington that was advertised at discount.
Lowe’s ‘rarely if ever’ sells discounted products at their original price, class action claims
Hern argues the advertised discounts and reference prices used by Lowe’s for certain products are false due to the company “rarely if ever,” actually offering the products at anything other than their perpetually discounted rate.
“Customers do not enjoy the actual discounts Lowe’s promises them, and the items are not in fact worth the amount that Lowe’s represents to them,” the class action says.
Hern claims Lowe’s is violating the Washington Consumer Protection Act. He demands a jury trial and requests declaratory and injunctive relief and an award of actual damages for himself and all class members.
Consumers filed a number of similar class action lawsuits against companies earlier this year over claims revolving around deceptive pricing, such as false discounts and misleading shelf pricing.
