A new Bubble Yum class action lawsuit alleges The Hershey Co. violates California law by failing to disclose the presence of “forever chemicals” in its products.
Plaintiff Abraham Mohamed alleges Bubble Yum Original Flavor Bubble Gum contains organic fluorine, which increases the risk of consumers’ exposure to per- and polyfluoroalkyl substances, or PFAS.
The California legislature refers to PFAS as forever chemicals because they are resistant to degradation and tend to persist in human bodies and in the environment, Mohamed says.
PFAS have reportedly been linked to significant health issues including hormone disruption, immune system disruption, kidney and liver damage, thyroid disease and various cancers.
Mohamed claims he frequently purchased Bubble Yum products because he believed Hershey’s marketing and its purported commitment to “safeguard the health of the environment” and “being transparent about the ingredients in your favorite Hershey products.”
Independent testing shows presence of Bubble Yum forever chemicals, plaintiff says
Mohamed says he commissioned independent third-party testing to determine whether Bubble Yum and its packaging contain organic fluorine. The test results reportedly showed the presence of organic fluorine in the bubble gum and the packaging that exceeded California’s permissible manufacturing limits.
“Therefore, both rounds of testing indicate dangerous levels of organic fluorine that implicate health and safety concerns,” the Bubble Yum class action lawsuit says.
He says Hershey should have disclosed the presence of Bubble Yum PFAS and the potential health risks associated with them.
Mohammed filed the Hershey class action lawsuit on behalf of a proposed class who purchased Bubble Yum products in California in the last four years.
He asserts claims for false and misleading advertising in violation of California’s Business and Professions Code and the Consumers Legal Remedies Act.
Massachusetts residents recently filed a class action lawsuit alleging 3M and other chemical manufacturers contaminated Nantucket’s water supply with forever chemicals.
