How Many People Do You Need to File a Class Action Lawsuit?

A class action lawsuit may be filed by one plaintiff or a group of plaintiffs. However, in order to qualify as a class action lawsuit, the plaintiffs must be able to show that a large number of other people suffered similar harm and will be similarly affected by the outcome of the lawsuit. The plaintiffs will serve as Class representatives and bring the litigation on behalf of putative Class Members.

After the class action lawsuit is filed, the defendant will have a chance to respond to the litigation. Eventually, the class action lawsuit may make it to the Class certification stage. At this point, the plaintiffs will file a motion with the court asking the judge to certify one or more Classes and/or subclasses.

How Many Class Members Do You Need?

In most cases, there is no specific number of putative Class Members required before a plaintiff files a class action lawsuit. The legal requirement is that the Class be “so numerous that the joinder of all members is impractical.” This means that the group of people being represented in the class action lawsuit is so large that it would be extremely difficult or impossible to bring each member before the court to appear as the plaintiff party. The issue of whether Class certification is appropriate in a case depends on the specific facts and circumstances of the case.

    I really need help here in BEAUMONT TEXAS. I have a complaint against a used car dealership which was under the name (drive away motors) they have conducted business under several names such as happy motors, memorial motors and AAA motors are just a few. When they start getting complaints they change their name. This dealership has several complaints from customers with the BBB. for the same or similar situations as I have. I purchased a vehicle from them in 3/3/16 I didn’t get to the gas station 2 blocks down the street before the vehicle started giving me problems unfortunately I was their last customer for the evening so I couldn’t go back because when I left they were locking. I called them the next day 3/4/16 they told me to bring the vehicle back leave it with the keys and they would have their mechanic look at it and make any necessary repairs. I asked how long would it take the sales man Doug Long said call in a couple of days and we should have it done well after a month and several visits and phone calls my vehicle had not been repaired or even checked. So finally I came in and spoke with management (Crystal) because now they were harassing me for payment. They sent me a letter stating they were going to repo my vehicle and sell it. I told them I don’t have the vehicle you do. Management Crystal) said she believes they sold it because I supposedly told someone I didn’t want it anymore which was not true . I asked her if they could just put me in something else of the same value she said no so I told her well you need to give me back my $1,000 down payment I didn’t have this vehicle for a day and they told me to bring it back and leave it. I have tried and tried no one seems to be able to help me I’m on disability and don’t have $1,000 to give away. On April 30th 2019 they agreed to go into mediation and discuss this. I had to spend money for this mediation which I didn’t have only for them to tell me they didn’t remember me but they would be willing to accept the original $1,000 that they have as a down payment and have me sign for another vehicle I told them no I wanted my money. Management (Crystal) said oh well take us to court and you still are going to lose. PLEASE PLEASE HELP ME!! I have written in before trying to start a class action but no one responded as of yet but these people need to be STOPPED!

    Maple frosted donuts or my favorite I have been eating Kristy Keene donuts a long time when I discovered that they sold maple frosted I was definitely on board after eating them they didn’t taste quite right about 45 min I would always get a tummy ache followed by diarrea
