Walmart and CaptureRx Slapped With Class Action Over Data Breach

Update:

  • A Texas federal judge has given preliminary approval to a $4.75 million settlement between CaptureRX and consumers in six separate class action lawsuits that all accused the pharmacy giant of negligence after a 2021 data breach.
  • The breach exposed the prescription information, first and last names, and dates of birth of more than 2.6 million customers. California residents whose information was stored with CaptureRX can submit claims of up to $100 while consumers in other parts of the country will receive $25 cash payouts. 
  • As part of the settlement, CaptureRX will also have to “develop, implement and maintain a comprehensive information security program that is reasonably designed to protect the security, integrity and confidentiality” of patients’ personal data.
  • Class counsel says “these benefits represent a highly favorable compromise that balances the merits of plaintiffs’ claims and the likelihood of succeeding at trial and on appeal with the attendant risks. By settling now, the settlement class can take advantage of remedies that would be unavailable or worth substantially less by the time of a litigated final judgment.”

Walmart and CaptureRx recklessly violated the privacy rights of Missouri customers through a recent data breach that exposed personal information including prescriptions, a new class action lawsuit alleges.

An anonymous plaintiff filed the class action against CaptureRx and Walmart, Inc. Tuesday in a Missouri federal court, alleging the companies violated multiple federal and state laws in the handling of a Feb. 6, 2021, data breach.  

The customer says CaptureRx’s patients entrusted their personal health information (PHI) to it and Walmart, but the companies “betrayed” them by not properly safeguarding that information. 

In the Feb. 6 breach, the customer and thousands of others had their first name, last name, date of birth, and prescription information exposed to third parties, according to the claim.

“Defendants flagrantly disregarded Plaintiff’s and the other Class Members’ privacy and property rights by intentionally, willfully and recklessly failing to take the necessary precautions required to safeguard and protect Plaintiff’s and the other Class Members’ PHI and PII from unauthorized disclosure,” the class action states. 

The patient and other Class Members’ PHI and PII was improperly handled, inadequately protected, readily able to be copied by thieves and not kept in accordance with basic security protocols, the claim alleges. 

The patient adds that individuals whose PHI and PII is subject to a reported data breach are approximately 9.5 times more likely than the general public to suffer identity fraud or identity theft, according to Javelin Strategy & Research, a provider of quantitative and qualitative research.

The Walmart customer is seeking to represent all Missouri citizens who were patients or guardians of patients of the companies since Aug. 31, 2016, and whose personal identifiable information (PII) was exposed to third parties in the breach. 

The patient is suing for breach of implied contract, negligence, invasion of privacy by public disclosure of private facts, breach of duty of confidentiality and violations of Missouri merchandising laws, as well as seeking certification of the class action, damages, proper notice of the breach, fees, costs, interest and a jury trial.

    I was just affected by the data breach. Someone just tried to buy stuff off Walmart.com with my card I have been on the phone all morning getting a new card I am in Missouri and the transaction is in AR United States Of America so now my money is on hold until I get a new card.

      I have my Walmart set it so when a purchase is made I would receive an email or text notification I did not receive one of them informing me of the purchase that happened on my card in AR United States Of America. I called and canceled my card

    Please add me since I had identity theft earlier this year and shop at Walmart all the time here in California. What a pain to clear it all up!
