Thousands of Lawsuits Allege Severe Vaginal Mesh Implant Complications

A vaginal mesh implant is permanently implanted into a woman’s body to reinforce a weakened vaginal wall. Vaginal mesh implants are most commonly used to treat pelvic organ prolapse. - Mesh erosion

Many of these complications require surgical correction. Often, patients will require multiple surgeries to correct the damage caused by the vaginal mesh implant. In some cases, the damage caused by the implant cannot be fully corrected. If the mesh becomes embedded in body tissue, becomes extremely difficult to completely remove the device from the woman’s body.
After receiving numerous complaints from women who suffered serious vaginal mesh implant complications, the FDA ordered the vaginal mesh manufacturers to participate in post market safety tests to find out more about the risks associated with the products. Most of these manufacturers did minimal pre-market testing because they were able to claim that their products were substantially similar to hernia treatment devices that were already on the market.
Thousands of Vaginal Mesh Implant Lawsuits Have Been Filed
The FDA has acknowledged that vaginal mesh implant complications are not rare and that pelvic organ prolapse may be more effectively treated with traditional surgical procedures. Thousands of women who have suffered severe side effects from bladder sling implants and vaginal sling implants are taking legal action against the device manufacturers. They allege that the manufacturers failed to warn women and physicians about the serious complications associated with the implants. Most of these cases have been consolidated into multidistrict litigation (MDL). The pretrial proceedings of cases that have been consolidated into MDL will be handled by one federal judge.
In the first vaginal mesh lawsuit to reach trial, the jury awarded more than $11 million in damages to the plaintiff. This award consisted of $3.35 million in compensatory damages and $7.76 million in punitive damages. In this case, the jury found that the manufacturer had failed to adequately warn the plaintiff and her doctor about the risks associated with vaginal mesh implants. She underwent 18 operations to repair the damage caused by the implant.
