Lincoln Property Co. (LPC) and other defendants have agreed to a $4.16 million class action lawsuit settlement benefiting individuals who paid certain rental application fees and other fees for apartments.

The Class is made up of all individuals who paid rental application fees and lock-and-key fees to Lincoln Property Co. or Lincoln Property Apartment Management LP in the Commonwealth of Massachusetts. The Class includes all tenants or prospective tenants of Jefferson at Salem Station, who paid such fees between July 8, 2010, and Nov. 22, 2019.

A class action lawsuit had accused the defendants — Lincoln Property Co., Salem Station LLC, and Lincoln Asset Management Limited Partnership — of charging application fees and lock-change fees on apartments in violation of Massachusetts Law.

Lincoln Property Co. is a Texas-based real estate firm that offers commercial and residential properties, such as apartments, throughout the United States and in Europe.

The defendants deny all liability as to the claims and damages alleged in this case.

LPC Lawsuit Settlement Benefits

Class Members who paid an application fee and/or lock-change fees to one of the defendants or communities identified in Exhibit A will be reimbursed up to 200 percent of the paid fee or a minimum of 100 percent of such fees paid, with that percentage being subject to a proportionate reduction if the total value of the approved claims exceeds the amount of the settlement fund.

In addition, Lincoln Property Co. has agreed to stop charging application fees and lock-change fees in excess of the actual amount incurred to change a lock at the start of tenancy of apartments in Massachusetts.

The deadline to object to the LPC class action lawsuit settlement is June 17, 2021.

The deadline to submit a claim form will be 180 days from the date of the final order of final approval from the Court.

The final fairness hearing is scheduled for July 8, 2021, which would make the claim deadline on or around Jan. 4, 2022.

Who’s Eligible

Potential Award

    I live in Virginia and I was looking for a place to live and I went to apartment area called Lincoln Muse and they charge me an application fee . And I think they charge me a lot fee even though I hadn’t even got the place. So does it include this rental property this rental property. I don’t have a way to print out the claims form is there a way I can do it online
