Merck & Co. are facing a new Zostavax lawsuit, which was jointly filed by several claimants alleging they developed adverse shingle vaccine side effects.
Each of the claimants alleges they developed adverse shingle vaccine side effects soon after receiving the Zostavax vaccine, including the development of shingles and other serious complications.
The shingle vaccine side effects described in this Zostavax lawsuit are similar to those reported by other patients who have allegedly been developing complications after receiving the vaccine.
New York plaintiff Theresa Q. alleges she had the Zostavax vaccine implemented on March 12, 2014, but the vaccine had allegedly failed to prevent shingles and allegedly caused her to develop a persistent strain of shingles. On June 16, 2016, Theresa had sought medical attention for rash and was diagnosed with shingles during the appointment.
New York plaintiff Michael A. says he had the Zostavax vaccine implemented in November 2010, which was allegedly recommended by his physician to prevent shingles. Howeve, the vaccine had allegedly failed to prevent shingles and allegedly caused him to develop a persistent strain of the condition in July 2016.
New York plaintiff Esther B. alleges she had the Zostavax vaccine implemented on Nov. 7, 2012, which was recommended by her physician. However, the vaccine allegedly failed to prevent shingles and had allegedly caused her to develop a persistent strain of the condition.
Each of the claimants in the Zostavax lawsuit has had to contend with their new medical condition and have had to undergo extensive treatment procedures. Theresa and the other claimants allege the Zostavax vaccine failed to prevent shingles, and Merck had failed to warn them against the potential shingle vaccine side effects.
Overview of Shingle Vaccine Side Effects
These injury reports have spurred a class action investigation, which is open to patients who allegedly developed shingle vaccine side effects after receiving Zostavax. Zostavax is an immunization vaccine for shingles, which is routinely prescribed to people over the age of 50 to prevent the onset of this condition.
The Zostavax vaccine contains a weakened strain of the chickenpox virus, which helps the immune system counteract the onset of shingles. Shingles is thought to be caused by a dormant strain of chickenpox and can be a painful condition to contend with.
However, Merck has recently released patient drug safety information regarding Zostavax, stating that patients could experience adverse shingle vaccine side effects including headaches, local reactions to injection, fever, joint pain, muscle pain, nausea, chickenpox, or shingles development.
Some patients have reportedly developed more serious reactions such as spinal cord inflammation or cardiovascular events. Even though these shingle vaccine side effects can be devastating to patients, plaintiffs claim Merck allegedly failed to warn patients against these complications in a timely manner.
Theresa and the other claimants in the Zostavax lawsuit state that they and their physicians had relied on the information provided by the pharmaceutical company, and had no way to discover the adverse shingle vaccine side effects at an earlier time.
The claimants in this Zostavax lawsuit are seeking multiple damages against Merck, including counts of negligence and failure to warn.
This Shingles Vaccine Side Effects lawsuit is Case No. 2:18-cv-03849-SJF-AKT in the U.S. District Court for the Eastern District of New York.
