Pharmaceutical giants Janssen Pharmaceuticals and Bayer HealthCare, are facing a new product liability lawsuit alleging Xarelto fatal bleeding.
The Xarelto lawsuit is being filed on behalf of a deceased patient, who allegedly suffered fatal internal bleeding injuries.
Florida plaintiff Sherri C. is filing on behalf of Wilbert C., who was prescribed Xarelto to prevent blood clot attacks.
This medication is popularly used to treat patients with atrial fibrillation, and who are at high risk for stroke.
However Xarelto fatal bleeding complications have been reported by many patients, which has resulted in numerous Xarelto lawsuits consolidated into one multidistrict litigation (MDL).
During his Xarelto prescription, Wilbert followed all warning label instructions and followed additional advice from his physician.
Even though Wilbert followed all necessary precautions, he still experienced Xarelto fatal bleeding.
According to the Xarelto lawsuit, Wilbert experienced severe gastrointestinal bleeding and ultimately died from his injuries.
Xarelto Fatal Bleeding Risks
Xarelto is a popular anticoagulant medication that was released as a joint effort between Bayer HealthCare and Johnson & Johnson’s subsidiary, Janssen Pharmaceuticals.
Approved by the FDA in 2011, this medication was approved to treat patients with atrial fibrillation and are at high risk for blood clot formation.
Xarelto is the second addition to the line of recently developed anticoagulants, which were released to directly compete with Warfarin.
These new generation anticoagulants were advertised to be more efficient than their predecessor, and quickly grew popular due to their single dose prescription regime.
However unlike Warfarin, Xarelto does not have a widely available reversal agent in the case of internal bleeding incidents.
Even though Bayer and Janssen allegedly knew the dangers of potential Xarelto fatal bleeding incidents, the companies omitted this information from the drug’s warning label.
At some point after Wilbert’s death, Sherri became aware of potential Xarelto fatal bleeding incidents and filed legal action against the manufacturing companies for failing to warn them.
Sherri points out that Wilbert agreed to use the medication based on the companies’ Xarelto advertisements, with his physician having no awareness of potential uncontrollable bleeding complications before taking the medication.
In her Xarelto lawsuit, Sherri alleges Bayer and Janssen did nothing to warn Wilbert or his prescribing physicians of these severe side effects.
Sherri further states that Wilbert never would have used the medication, if he had known about the possibility of Xarelto fatal bleeding injuries.
Sherri is seeking damages for multiple counts of negligence and failure to warn, along with Wilbert’s wrongful death.
Sherri’s Xarelto lawsuit is filed in MDL No. 2592, where it will stand alongside other Xarelto claims alleging similar injuries.
The Xarelto Fatal Bleeding Lawsuit is Case No. 2:16-cv-16263, in the U.S. District Court of the Eastern District of Louisiana.
