man with herniaAtrium Medical Corporation is facing a growing multidistrict litigation (MDL), consisting of product liability claims alleging problems with mesh used in hernia surgery.

One of the most recent claims comes from a Colorado man, alleging he had suffered problems with mesh used in hernia surgery. The man alleges these complications forced him to undergo multiple revision surgeries, with the company either knowing or should have known about the defective nature of the hernia mesh product.

Colorado plaintiff David H. opted to file this hernia mesh lawsuit, alleging numerous problems with mesh used in hernia surgery had caused the need for multiple revision procedures. According to their hernia mesh lawsuit, David opted to have the C-QUR Mesh V-Patch implanted after reviewing marketing materials provided by Atrium.

According to these advertisements, the C-QUR Mesh V-Patch would be a suitable choice for his hernia repair due to the omega-3 fatty acid coating of the metal. This coating is specifically implemented to initiate a biological response of the body, which causes the surrounding muscle to swell around the surgical mesh.

With these marketing statements in mind, David had the C-QUR Mesh V-Patch implanted on June 4, 2010. He reportedly suffered problems with mesh used in hernia surgery soon after. The problems with mesh used in hernia surgery included the need of hernia mesh removal, severe pain, infection, and recurrent repair.

These hernia mesh complications eventually forced David to undergo revision surgery on Aug. 16, 2010, and again on Jan. 27, 2011. David allegedly continues to suffer problems with mesh used in his hernia surgery, and he opted to file legal action after discovering other patients may have experienced similar problems.

Overview of Hernia Mesh Complications

Surgical mesh has been used for hernia repair for decades, providing support to weak or damaged muscles in the abdominal area. Hernia mesh is supposed to alleviate this pain and help patients return to normal routine, but a number of hernia mesh products have come under fire for serious injury reports.

Hernia mesh products made by Atrium Medical Corporation are no different, with David being one of the most recent patients to file legal action. David is filing his hernia mesh lawsuit in MDL No. 2753, where it will stand alongside other claims alleging similar problems with mesh used in hernia surgery.

By joining an MDL, David’s hernia mesh lawsuit will be streamlined through the litigation process and will avoid potential problems like facing conflicting rulings from different judges.

David states he would never have agreed to use of hernia mesh if he had known the potential problems associated with mesh used in hernia surgery. More specifically, David was unaware of the potential complications associated with the omega-3 fatty acid coating on the C-QUR Mesh V-Patch. Numerous patients have reported developing infections and inflammation which caused them to develop fever and severe pain.

In cases of hernia mesh failure, the incision site will often not heal and will emit heat. Most patients who developed these mesh complications had to undergo corrective hernia surgery in order to repair these problems with mesh used in hernia surgery.

David is filing this hernia mesh lawsuit seeking multiple damages for negligence and failure to warn.

This Hernia Mesh Lawsuit is Case No. 1:18-cv-00022-LM, in the U.S. District Court for the District of New Hampshire.
