A Minnesota woman has filed a new Biomet hip lawsuit, alleging the company’s popular hip implant device caused her serious injuries as well as revision surgery.

The plaintiff, Julia M., says she was implanted with a Biomet hip device in her left hip on Jan. 24, 2007. However, in the months and years following insertion of the device, Julia says she began to suffer from pain and other complications.

Eventually, in June 2017, Julia underwent a revision surgery to remove the device. She says she was found to have suffered from severe pain and bone tissue loss, as well as a large pseudotumor and high levels of cobalt and chromium.

The specific device named in the Biomet hip lawsuit is the M2A-Magnum Hip Replacement System, a popular hip replacement option. The Biomet M2A Magnum system is a metal-on-metal device, where its ball and socket are metal in direct contact.

Unfortunately, the Biomet hip lawsuit alleges, the design of this device generates metal debris as the metal rubs together, allowing debris to spread through to the patient’s bone and tissue. According to Julia’s Biomet hip lawsuit, her hip implant caused her major complications because of this defect, including metallosis, severe pain, pseudotumor, and lack of mobility.

According to the Biomet hip lawsuit, Biomet was aware of the defects associated with its device but failed to adequately warn the public and the medical community about these risks.

Julia filed her Biomet hip lawsuit on Aug. 23, 2018, in the U.S. District Court for the Northern District of Indiana. The lawsuit was filed on multiple counts, including negligence, manufacturing defect, design defect, inadequate warning, and breach of express and implied warranties. Julia’s spouse, John, also filed on one count of loss of consortium.

Biomet Hip Implants

The M2A Magnum Hip System from Biomet, as well as other metal-on-metal hip implant systems like it, were developed in order to effectively reconstruct human hip joints. These joints may need implants because of conditions such as osteoarthritis, rheumatoid arthritis, avascular necrosis, and/or fracture.

Lawsuits claim that the device’s metal-on-metal design is defective and dangerous. Metal-on-metal devices can allow the metal components to rub together, releasing small metal particles into the bloodstream and surrounding tissue. This can cause metallosis, toxicity, and device failure. Biomet lawsuits allege that the design was insufficiently tested, and when Biomet had knowledge of the defects and risks, it sought to cover them up to bolster sales.
