Mirena IUD migratedA Louisiana woman has filed a personal injury lawsuit against Bayer, the manufacturer of the Mirena IUD.  Her lawsuit alleges that she suffered critical side effects from the birth control device.

The Mirena IUD is a type of birth control designed to be inserted into the uterus by a physician. Once in place, it is designed to block pregnancy for up to five years. However, hundreds of Mirena lawsuits like this one allege that the IUD can cause serious complications.

Plaintiff Kimberlee Ross allegedly suffered from a perforated uterus, a situation in which the Mirena IUD punctures the uterus and damages the organs of the abdomen. It required emergency surgery to remove the IUD, according to the Mirena lawsuit.

Hundreds of similar Mirena lawsuits have been filed, alleging that the Mirena IUD can puncture the uterus, causing serious internal damage. These have been consolidated into multidistrict litigation. An MDL or Mass Tort is a type of group lawsuit, similar to a Mirena IUD class action lawsuit. The main difference is that class action lawsuits are typically filed as a group, under the guidance of a single legal team, while MDLs generally start as dozens (or hundreds, or even thousands) of individual lawsuits are later combined into a single coordinated legal action. MDLs are more common than class action lawsuits in cases with allegedly-defective drugs and medical devices, since individual plaintiffs often file their lawsuits without realizing that similar suits are being filed across the country.

If a Mirena IUD punctures the uterus, these lawsuits allege, it can cause serious damage to the uterus and the organs of the abdomen. Complications including internal scarring, infection, and permanent sterility have been reported. Additionally, women who have gotten pregnant—allegedly due to a failure of the device—have reported a much higher rate of complications such as ectopic or tubal pregnancy.

The case is formally titled Kimberlee Ross vs. Bayer Healthcare LLC, et al, filed in the United States District Court for the Western District of Louisiana.
