A new lawsuit argues that a man regularly exposed to working environments in which he breathed asbestos fibers developed cancer as a result. The lawsuit says that he and other employees should have been warned about the dangers of breathing in these materials or in getting them attached to the worker’s clothing, bringing them home for further exposure.
Plaintiff Ana S. has filed the lawsuit individually and on behalf of the estate of her deceased husband who allegedly died from complications associated with mesothelioma asbestos cancer. The plaintiff alleges in her lawsuit that her husband developed malignant mesothelioma as a result of exposure to asbestos and asbestos containing products.
The mesothelioma asbestos lawsuit was filed against Arconic Global Fasteners & Rings, Inc. and a number of other different companies that are named as suppliers of asbestos containing products.
Ana says that her husband could have been exposed to grind, saw, or cut products that had asbestos inside. The lawsuit says that these products were dangerous to the health and safety of the decedent and others who were working in similar positions using or in close proximity of those products.
The mesothelioma asbestos cancer lawsuit says that since at least 1930, the hazards and risks of these products were known by the defendants and yet employees working in the same capacity as the decedent continued to be exposed to these dangers.
Mesothelioma asbestos cancer has a long latency period, meaning that a person could be exposed to it and develop conditions and symptoms decades down the road.
According to the lawsuit, the decedent sustained numerous permanent injuries to his health, body and person, including loss of weight, pain, discomfort, lethargy, fatigue, loss of appetite, dysphagia, and other physical symptoms as a result of mesothelioma asbestos cancer. Ultimately, these complications led to his death in March 2018, alleges his wife.
The mesothelioma asbestos cancer lawsuit says that the defendants and their alternate entities regularly failed to provide information to workers about the nature of the products, which were dangerous when breathed and could ultimately cause pathological effects.
Employees in particular industries may be at risk of developing mesothelioma asbestos cancer in their later years due to continued exposure to the dangerous fibers. While asbestos cannot be used in most building materials today, some products contain asbestos and certain jobs requiring tearing or destroying materials with asbestos inside.
One of the greatest challenges with mesothelioma asbestos cancer is that the symptoms might not emerge until so many years later, meaning that the person exposed might not be aware of the risks of inhaling this material until it is too late.
The Asbestos Lawsuit is Case No. BC721318; filed in the Superior Court for the State of California, for the County of Los Angeles.
