The lead plaintiff has initiated this waste companies lawsuit as a class action, since the plaintiff alleges that other employees were similarly affected by the improper payment of overtime work hours. The waste companies lawsuit says that this action was brought forward in court for failure to pay overtime compensation as required by the Fair Labor Standards Act (FLSA)

Waste workers might be required to work above and beyond the typically required 40 hours in a workweek to meet their job responsibilities, and more workers are alleging that they have to do this but are not being compensated fairly for the overtime work hours logged.

When workers entitled to receive overtime are not paid for these additional hours, the only recourse might be legal action against the employer.

Unpaid Overtime

According to the waste companies overtime work hours lawsuit, the defendant is a Houston based company that provides recycling services for industrial and commercial businesses.

The plaintiff, Harvie M., is a driver who collects these items and transports these materials to be recycled in the Houston area. However, according to the plaintiff, this collective waste companies action has been brought to recover liquidated damages, attorney’s fees, unpaid overtime work hours compensation, court costs, litigation expenses, and pre- and post-judgment interest due to failure to pay appropriate overtime.

The lawsuit alleges that the defendants willfully committed FLSA violations for at least three years prior to the filing of the plaintiff’s legal complaint, as the employees regularly worked in excess of 40 hours each week.

The Fair Labor Standards Act has specific requirements about when and how companies must pay overtime work hours based on the classification of the employee and the total hours logged. The plaintiff was employed by the defendant from November 2017 through June 2018. He says he was paid a salary and consistently worked over 40 hours per week.

He alleges in his waste companies overtime work hours lawsuit that he was a non-exempt employee but never received appropriate premiums for hours worked beyond 40 in a week.

The lawsuit alleges that the defendants maintained oversight control and directions over their operations including the employment practices and had the sole power to hire, fire and discipline the plaintiff as well as all other similarly situated employees.

The waste companies lawsuit says that the plaintiff is aware that these allegedly illegal practices and policies were imposed on other employees, since others were paid on a salary basis and worked more than 40 hours per week despite the fact that no overtime compensation was paid for those excess hours logged beyond the initial 40.

The lawsuit is seeking restitution on behalf of other employees working for trash pickup services who argue that their employers have violated wage and hour laws. A wage and hour lawsuit attempts to recover the unpaid overtime.

The Waste Companies Lawsuit is Case No. 4:18-cv-02127 in the U.S. District Court, Southern District of Texas, Houston Division.
