GSK Consumer Health and GlaxoSmithKline Consumer Healthcare Holdings have agreed to a $6.5 million settlement to end a Benefiber class action lawsuit alleging the product is not 100 percent natural as advertised. U.S. consumers who purchased Benefiber Healthy Shape and other products are eligible to claim up to $60 without proof of purchase.

The Class is made up of all individuals who purchased Benefiber Healthy Shape Prebiotic Powder Fiber Supplement, Benefiber Original Prebiotic Powder Fiber Supplement, Benefiber Sugar-Free Powder Fiber Supplement, Benefiber Prebiotic Powder Fiber Supplement On-The-Go Stick Packs (Flavored or Unflavored), and/or Benefiber Prebiotic Fiber Supplement Chewables for personal or household use, not for resale, in the United States between June 19, 2014, and June 8, 2021.

The plaintiffs in two Benefiber class action lawsuits had alleged GSK was deceptive in its advertising, marketing, and labeling of Benefiber Original and Benefiber Healthy Shape products as “100% Natural” or “natural.” In addition, the company allegedly marketed its Benefiber Healthy Shape products as being “clinically proven to cure cravings” as a means of weight management, when it was actually the same product as Benefiber Original.

Benefiber is a fiber supplement intended to help consumers maintain proper digestive health.

GSK Consumer Health and GlaxoSmithKline Consumer Healthcare Holdings, developers of vaccines and other pharmaceutical products, deny all allegations of wrongdoing put forth in the Benefiber class action lawsuit. 

However, they have agreed to the settlement in order to avoid the risks and expense of continuing with litigation.

Benefiber Settlement Benefits

Class Members who vile a valid claim will be eligible for an estimated $10 per purchase of Benefiber Original. 

Those who purchased Benefiber Healthy Shape may claim up to $12 per purchase.

Class Members may claim up to five units of either product without proof of purchase; however, proof of purchase is required on all claims for more than five units of Benefiber Original or Benefiber Healthy Shape.

There is no limit on the number of units that can be claimed with proof of purchase, but only one claim may be filed per household. 

The payment amounts may be adjusted depending on the number of claims submitted.

In addition to the monetary relief, GSK has agreed to stop manufacturing the covered products with labels that read “100% Natural” until such time it receives appropriate guidance from the U.S. Food and Drug Administration.

GSK also will stop using “clinically proven to cure cravings” on the Benefiber Healthy Shape products and their advertising until reliable scientific evidence supports those stated effects among U.S. consumers.

A final hearing in the Benefiber class action settlement is scheduled for Nov. 18, 2021.

The deadline to opt out of or object to the settlement is Sept. 7, 2021.

The claim deadline is Oct. 6, 2021.

Receipts or any other document, such as e-mail receipts and photographs or other reliable documentation establishing a purchase, demonstrating the claimant purchased Benefiber Original and/or Benefiber Healthy Shape.

    Received check in the mail but it declined transaction when trying to cash. I never asked for a paper check gave direct deposit info but way good did that do?!?
