Electrolux refrigerator defect class action lawsuit overview: 

  • Who: David Stern filed a class action lawsuit against Electrolux Home Products Inc. 
  • Why: Stern claims Electrolux knowingly sells refrigerators containing defective drawers and shelves he says are flimsy and prone to breaking within months of purchase. 
  • Where: The class action lawsuit was filed in New York federal court. 

Electrolux Home Products sells refrigerators built with drawers and shelves that “repeatedly break and fall apart within months after purchase,” a new class action lawsuit alleges. 

Plaintiff David Stern claims Electrolux “knew or was reckless in not knowing” that the refrigerators contained the allegedly defective shelves and drawers prior to the first unit being sold. 

“Notwithstanding this knowledge, Electrolux made uniform and material misrepresentations and uniformly concealed material information in its marketing, advertising and sale of the Refrigerators,” the Electrolux class action states. 

Stern argues that, instead of attempting to fix the refrigerator defect, Electrolux simply continued manufacturing refrigerators with defective drawers and shelves. 

“Electrolux did not implement a plan to address the defect and instead manufactured and sold subsequent models that contained the same defect,” the lawsuit states. 

Electrolux class action accuses company of negligence over alleged refrigerator defect

The refrigerator defect causes damaged and unusable food due to the “repeated breakage of the flimsy shelving and drawers,” resulting in the waste of otherwise “fresh and unblemished produce,” the Electrolux class action alleges. 

“Because of the Defect, the Refrigerators are deficient; do not meet advertised standards and fail of their essential purpose,” according to the lawsuit. 

Stern claims Electrolux is guilty of negligent misrepresentation and unjust enrichment, among other things, and in violation of New York General Business Law

Plaintiff demands a jury trial and requests injunctive and declaratory relief along with actual, treble and/or statutory damages for himself and all class members.

Stern wants to represent a nationwide class and New York subclass of consumers who own or have owned an Electrolux refrigerator containing allegedly defective drawers and shelves. 

Electrolux recalled certain Elecrolux and Frigidaire refrigerators earlier this month over concerns their ice level detector arms could break into pieces and become a choking hazard by falling into the ice bucket.

    I think the plastic is defective in our Frigidaire Gallery Refrigerator. First a half moon piece of the cheese drawer handle broke off. That was not alarming. Now a shelf support across the front of a drawer, the biggest bottom drawer, the little shelf in the door broke. If I could order each of the replacements it would cost hundreds of dollars. The ice maker doesn’t work. It seems odd to buy a new refrigerator because the drawer broke but it is a real annoyance to have it become more unuseable.

    Please add me , in 2016 we had to go with fridgedaire brand we couldn’t fit the other fridge picked out at lowes. It started cracking and fell apart easily. There’s tiny cracks inside the white part of the fridge, all door shelves all gone because they broke one by one. The glass shelves white plastic are cracked I’ve hot glued for awhile but they are done. I know things break and over time mabie but I’ve never seen anything like this in my life. You would thing somebody got a bat and beat the inside of the fridge. Never buying anything in fridgedaire brand again.

    I have had to replace the refrigerator shelves three times already and my refrigerator is only about three years old. I do not store heavy two liter bottles etc in/on the shelves. The shelf holder just breaks away and throws all my food to the floor when I open or close the refrigerator. I also had a terrible leak within a year of purchasing my frigidaire refrigerator, finally after waiting almost a month, found a repairman who was selected and confirmed to be an Electrolux repairman come to my home and replace a faulty valve causing the leak. He told me Electrolux would repair my kitchen floor due to the faulty valve, I turned in all as per requested to only have the company send me a text telling me the valve was okay, the hook up line was loose and that is what suddenly caused the leak that damaged my floor. Refrigerator had not been moved since installation by the folks Lowe’s sent to my home following my purchase, it was okay for a few months and then suddenly I came home to a flooded kitchen floor.

    Our door handles will not stay on without constantly tightening and now one of my handles is broken.

    Please add me, my ice maker stopped working shortly after I purchased my Frigidaire and the drawers and shelves also broke shortly after purchasing this frigid.

      The same thing is happening with my nearly new refrigerator. The shelves keep sliding off and all of my food falls onto the shelf beneath it. The plastic trim piece in the back broke and instead of being able to purchase just that piece as a replacement, they make you buy a whole new glass shelf for $85.00! And THERE IS NOTHING WRONG WITH THE GLASS SHELF! They make you pay $85.00 for NOTHING! The glass shelf is fine. It’s the plastic support piece at the back that breaks, and it will just break again and again. IN ADDITION, the width of the shelves is not wide enough to set tightly on the support, so it just keeps sliding off. And they tell you that it isn’t covered by the warranty because the shelf is just “cosmetic”! How the hell is the shelf cosmetic? Am I supposed to stack boxes inside to hold all of my food? This is insane!
