Certain California AT&T customers with unlimited data plans may be eligible to benefit from a $12 million class action settlement over alleged data throttling.
All consumers residing in California (based on the account holder’s last known billing address) who purchased an unlimited data plan from AT&T Mobility LLC and who, on or before March 31, 2021, exceeded AT&T’s applicable data usage threshold for any user on the account for one or more monthly billing cycles such that the user would have been eligible for data usage slowing or deprioritization by AT&T in those billing cycles under AT&T’s network management policies are considered Class Members.
The plaintiff in a class action lawsuit had alleged AT&T “lured consumers” into buying smartphones, wireless cards, and service plans by promoting “unlimited” data; however, the company failed to alert customers about its practice of throttling data.
Allegedly, AT&T intentionally slowed data speeds on cellphones and wireless cards when a customer approached or surpassed AT&T’s internal data usage limits.
AT&T has not admitted to any wrongdoing, and the Court has not ruled in favor of either party.
Most Class Members in the AT&T data throttling settlement must file a claim in order to receive a payment.
Individuals can determine whether they need to file a claim by finding the Personal ID number on the Class notice they received.
Class Members with a Personal ID beginning with B must file a claim in order to receive a payment.
Those with a Personal ID beginning with C must file a claim to get the full payment they are eligible to receive. If they do not file a claim, they will receive a smaller payment.
Class Members whose Personal ID begins with an A do not need to file a claim in order to receive the full payment for which they are eligible.
Those who did not receive a notice but believe they belong in the Class may file a claim without a Personal ID. The AT&T settlement administrator will verify the claim.
Alternatively, they can email the administrator to get their Personal ID.
Payments will be divided into two groups, Group A and Group B. The payment amounts for each group will depend on multiple factors, such as how many claims are filed.
Those in Group A — their Personal ID begins with A — will receive an estimated payment of $10.
Those in Group B only — their Personal ID begins with B — who file a claim are expected to receive an estimated $13.
Class Members whose account falls under both Groups — Personal IDs starting with C — who file a claim are expected to receive both the Group A and B payments, for a combined payment of $23. Those in this group who do not file a claim will receive only the Group A payment of $10.
A fairness hearing in the AT&T settlement will take place Aug. 19, 2021.
The deadline to opt out of or object to the settlement is July 14.
The claim form deadline is Aug. 13, 2021.
Who’s Eligible
