Consumers who purchased certain Blue Diamond Almond Breeze vanilla almond milk and other products may be eligible to make a claim in a $2.6 million class action settlement with Blue Diamond Growers — with or without proof of purchase.

The nationwide Class is made up of all consumers in the United States who purchased the affected products between April 15, 2014, and May 17, 2021 (the Class Period).

The covered products include Almond Breeze almond milk, almond milk coconut or cashew blend, almond milk creamer, almond milk nog, and yogurt alternative products manufactured and labeled by Blue Diamond Growers during the Class Period that include reference to vanilla, including but not limited to the word “vanilla” or the phrase “vanilla with other natural flavors,” on the front of the package or in the ingredient statement.

A class action lawsuit had alleged consumers were tricked into thinking the Blue Diamond Almond Breeze yogurt products got their flavor from real vanilla because the company misrepresented the ingredients used to create the vanilla flavor.

Blue Diamond has not admitted to any wrongdoing, and the Court has not ruled in favor of either side in this case. The parties have agreed to the settlement in order to avoid the cost and burden of a trial.

Under the terms of the settlement agreement, Blue Diamond Growers has agreed to pay Class Members submitting valid claims.

Class Members submitting a claim without proof of purchase will be eligible to receive $.50 for each affected Almond Breeze product purchased, up to 10 products, for a total possible maximum payment of $5. If the total amount of claims submitted without proof of purchase exceeds $750,000, the payments will be reduced proportionately.

Class Members who submit proof of purchase with their claim will be eligible to receive a payment of $1 for each affected Almond Breeze product purchased, up to 20 products, for a total of $20. If the total amount of claims submitted with proof of purchase exceeds $1.25 million, payments will be redacted proportionately.

Only one claim may be filed per household.

A fairness hearing in the Blue Diamond vanilla settlement is scheduled for Aug. 25, 2021.

Those who would like to ask to be excluded from or to object to the settlement must do so by Aug. 4, 2021.

The deadline to submit a claim form is Nov. 23, 2021.

Proof of Purchase

A printed point-of-purchase receipt from a third-party retail source reasonably establishing the fact and date of the purchase of the affected product during the Class Period in the United States.
