DG Health Infants’ Acetaminophen $1.8M Class Action Settlement

Dollar General Corp. and related defendants have agreed to a $1.8 million settlement benefiting certain purchasers of DG Health Infants’ Acetaminophen, with or without proof of purchase.

All individuals in the United States who purchased DG Health Infants’ Acetaminophen between Sept. 15, 2016, and June 8, 2021, for personal or household use are considered part of the Class.

A class action lawsuit had accused the company of using deceptive practices to market and sell its over-the-counter DG Health infants’ pain reliever and fever reducer.

DG Health is Dollar General’s brand for healthcare products, including over-the-counter medicines, feminine hygiene products, and more.

Dollar General denies all allegations of wrongdoing or liability, but has agreed to the settlement in order to avoid the risks and expense associated with continuing litigation.

Class Members who provide proof of purchase for all their covered products during the Class Period will be entitled to a partial refund of $1.70 for every 1 fl. oz. and 2 fl. oz. bottle of infants’ acetaminophen for which they have a valid proof of purchase. 

There is no limit on the compensation Class Members can claim if they have proof of purchase. However, only one claim may be made per household.

Without proof of purchase, Class Members will be entitled to a partial refund of $1.70 for every 1 fl. oz. and 2 fl. oz. bottle of infants’ acetaminophen for up to three units, for a total of up to $5.10 per household. 

Class Members may not receive reimbursement for any bottle over three bottles unless they have proof of purchase for every bottle, including the bottles over the three-bottle maximum, according to the settlement website.

In addition to the monetary relief, the defendants have agreed to not sell DG Health Infants’ Acetaminophen unless it states the liquid medicine in the product contains the same concentration of liquid acetaminophen found in the DG Health Children’s Acetaminophen or includes substantially similar language on the product label or packaging.

A final hearing in the DG Health Infants’ Acetaminophen settlement will be held Oct. 28, 2021.

The deadline to ask to be excluded from or to object to the settlement is Oct. 11, 2021.

Claims must be submitted online or postmarked by Aug. 27, 2021.

Who’s Eligible

Proof of Purchase

A receipt or other documentation produced by a third-party commercial source that reasonably establishes the fact and date of purchase of the infants’ acetaminophen during the Class Period in the United States.
