If you received an unwanted text message from Wolford America Inc. either on July 7, 2016 or Sept. 2, 2016, you may be able to receive a $60 or $120 gift card from a class action settlement.

The Wolford America class action settlement puts to rest claims from consumers that Wolford sent unwanted text messages on two separate occasions.

The messages allegedly advertised a sale and a new collection by the boutique company. According to the plaintiff in the class action lawsuit, the text messages violated the TCPA because they did not include an opt out option and did not properly describe the sender.

The Telephone Consumer Protection Act, or TCPA, protects consumers from unwanted or harassing phone calls, text messages and faxes. The law was enacted by Congress in 1991 to reign in the use of telemarketers, robocalling, and autodialers.

It also provides the national Do Not Call registry that allows consumers to let companies know they do not want to be contacted with advertisements.

Companies who are found to have violated the TCPA can face steep fines – from $500 to $1,500 per violation.

Under the terms of the Wolford America TCPA class action settlement, Class Members can file a claim for either a $60 or $120 gift card that can be redeemed at the boutique – either in-store or online.

The amount of the gift card depends on the number of unwanted messages received by the Class Members. Those consumers who received just one of the unwanted text messages are entitled to a $60 gift card, while those who received both texts will get a $120 gift card.

Class Members can verify their claim by entering their phone number online or printing and mailing a Claim Form.

While not admitting any wrongdoing, per the Wolford America TCPA class action settlement, the boutique will pay out a maximum of $412,220 in gift cards to Class Members.

Claim Forms are due by Nov. 5, 2018. Class Members may object or exclude themselves from the Wolford America TCPA class action settlement by Oct. 5, 2018.

Who’s Eligible

Class Members include those who received either or both of the unwanted text messages from Wolford America on July 7, 2016 and/or Sept. 2, 2016.

$60 or $120 gift card

Proof of Purchase

Class Members must provide valid phone number(s) that received the text message(s).
