Delmonico’s website access ADA lawsuit Overview: 

  • Who: Windy Lucius filed a lawsuit against Delmonico’s Italian Steakhouse of Florida Inc. 
  • Why: Lucius claims Delmonico’s discriminates against blind and visually impaired consumers by failing to make its mobile website fully accessible to them. 
  • Where: The lawsuit was filed in Florida federal court. 

The mobile website for Delmonico’s Italian Steakhouse of Florida is at least partially inaccessible to blind and visually impaired individuals, a violation of the Americans with Disabilities Act, or ADA, a new lawsuit alleges.

Plaintiff Windy Lucius claims Delmonico’s website does not interact properly with VoiceOver screen reader software technology used by blind and visually impaired individuals to access mobile websites. 

Lucius argues Delmonico’s is denying blind and visually impaired consumers equal access to the goods and services on its mobile website on account of the accessibility issues. 

“Like the seeing community, Plaintiff would like the opportunity to be able to use the … mobile website,” the Delmonico’s lawsuit states. 

Lucius argues she will continue to be denied equal access to the goods and services offered on Delmonico’s website until it is required to update it to make it fully accessible to blind and visually impaired individuals. 

Delmonico’s lawsuit alleges restaurant ‘fully aware’ of website issues

Further, Lucius claims she is aware attempting to access Delmonico’s website with its current design would be a “futile gesture” that would only lead to her suffering “additional discrimination.” 

“Defendant and alike restaurants are fully aware of the need to provide full access to all visitors to its mobile website as such barriers result in discriminatory and unequal treatment of individuals with disabilities who are visually impaired,” the Delmonico’s lawsuit states. 

Lucius claims Delmonico’s is in violation of the Americans with Disabilities Act of 1990

The palintiff requests injunctive and declaratory relief along with other relief the court deems just and proper. 

Consumers have filed a number of class action lawsuits recently against companies such as Whole Foods, HelloFresh and Dell, among others, accusing them of failing to make their websites fully accessible to blind and visually impaired consumers.
