Plaintiffs in a class action lawsuit accused Dominion National of failing to adequately protect their personal information during the data breach. Dominion announced the breach June 21, 2019, and their forensic investigation found the attack may have begun as early as Aug. 25, 2010.

It is believed data such as names, birthdates, email addresses, Social Security numbers, and other sensitive information may have been accessed.

Those who have been identified as Class Members should have received an email or postcard notice about the data breach settlement.

Open for Claims

Class Members may be eligible for several types of relief under the terms of the settlement agreement:

  • Reimbursement for Lost Time: Class Members may file a claim for a cash payment for up to five hours of time lost to dealing with the security incident, at a rate of $20 per hour (for a maximum $100), if at least one full hour was spent dealing with the data breach. Class Members may receive compensation by submitting a certification that describes the time you spent.
  • Reimbursement for Ordinary Losses: Class Members may receive cash payments of up to $300 per person for ordinary losses incurred responding to the data breach upon submission of a claim and supporting documentation for out-of-pocket expenses incurred as a result of the data breach, including bank fees, long-distance phone charges, cellphone charges if charged by the minute, data charges if charged based on data usage, postage, or gasoline for local travel; and fees for credit reports, credit monitoring, or other identity theft insurance products purchased between Aug. 14, 2019, and July 19, 2021.
  • Reimbursement for Extraordinary Losses: Class Members may file claims for cash payments of up to $7,500 for extraordinary losses incurred responding to the breach for proven monetary loss, if the loss is an actual, documented monetary loss that was unreimbursed — except by the claimant’s insurer; the loss was fairly and reasonably traceable to the data breach; the loss occurred between Aug. 25, 2010, and Jan. 15, 2022; the loss is not already covered by one or more of the normal reimbursement categories; and the loss exceeds all available credit monitoring insurance and identity theft insurance provided to the Class Member by Dominion National.

If qualifying claims exceed $2 million in losses, compensation will be reduced proportionately.

Also as part of the data breach settlement agreement, Dominion National has agreed to take additional security measures worth approximately $2,679,500.

A final fairness hearing in the Dominion Dental data breach settlement was held Nov. 19, 2021.

The deadline to opt out of or object to the Dominion class action settlement has passed.
