Capital One credit card merger class action overview:ย

Capital One credit card holders have filed a class action lawsuit against Capital One and Discover, in an attempt to halt a merger between the two credit card companies that they allege will reduce competition in the credit card market.ย 

Credit card customers Tyler Baker and Lora Grodnick filed the class action lawsuit against Capital One Financial Corporation and Discover Financial Services on July 22 in a Virginia federal court, alleging violations of federal antitrust laws.ย 

According to the lawsuit, Capital Oneโ€™s planned $35 billion acquisition of Discover will lead to โ€œa substantial lessening of competitionโ€ and harm to credit card consumers.ย 

โ€œThe proposed merger will eliminate one of two vertically integrated general credit card market firms from the competitive landscape, seriously reducing price pressure on Capital One and other major issuers,โ€ the plaintiffs claim.

Merger diminishes payment processing market, plaintiffs claim

The plaintiffs allege the merger would also shrink the payment processing market.ย 

Discover is one of four companies in the domestic credit card payment processing market โ€” Visa, Mastercard, American Express, and Discover, the lawsuit states. Visa and Mastercard are the dominant credit card payment processors, with a combined near-monopoly share of 87%. They have a long history of colluding to raise prices and harm consumers, the plaintiffs say.

โ€œIn fact, Visa and Mastercard have previously been sued for colluding with Capital One to anticompetitively inflate interchange fees.โ€

With the merger, Capital One โ€” one of the nationโ€™s largest issuers of Visa- and Mastercard-serviced charge cards โ€” will become Visa and Mastercardโ€™s horizontal competitor and take control of one of the firmsโ€™ two meaningful competitors, the lawsuit claims.

Potential price fixing, reduced competition

The plaintiffs argue that this arrangement would leave Discover, one of the few serious competitors to Visa and Mastercard, negotiating prices in the market with these giants.ย 

This could potentially lead to price fixing and reduced competition in the Credit Card Payment Processing Market.ย 

The plaintiffs claim the merger could lead to higher prices and interest rates for consumers, as Capital One would control a significant portion of the market, increasing from the ninth to the sixth-largest bank in the nation.

As a result, the plaintiffs are suing on behalf of any person or corporation in the United States who directly or indirectly paid interchange fees as merchants or credit card holders from July 22, 2020 to now. Theyโ€™re suing for violations of the Clayton Act and the Sherman Act and are seeking an injunction blocking the merger.ย 

Meanwhile, merchants that accepted Visa or Mastercard at any time between Jan. 1, 2004, to Jan. 25, 2019, may be eligible for a share of a $5.6 billion class action settlement known as the โ€œPayment Card Interchange Fee Settlement.โ€ The deadline to file a claim is Aug. 30, 2024.     I successfully applied for and received a secured Discover credit card that required depositing a sum of money that creates the cardโ€™s credit line. After depositing $500, and receiving the account number and information for my new secured Discover card and activating my new Discover credit card, Discover required me to complete and send to them a notarized form confirming my identity as being the same one applying for (and funding) my card. Upon completing said notarized form through a notary at a law firm, Discover claimed that they had lost my form and required me to send them another, new copy of my notarized form โ€“ but this time, Discover required me to complete my notary at a bank, which I did provide to them via U.S. Bank. By this time, I had already linked my secured Discover card with my online Discover Bank checking account and was in physical possesion of my Discover card. However, Discover was still denying that I am the same person who had successfully applied for and funded my secured Discover credit card because โ€“ they claimed โ€“ the notary at U.S. Bank was not a local branch, which is false, because I had provided Discover with the U.S. Bank notaryโ€™s direct line, Discover was still refusing g to allow me to use my new card. Discover now required me to complete the notarized form via a notary at UPS, which I did provide to them. But Discover said that when they called the notary at the UPS location that I had my notary completed at, the UPS notary agent placed them on hold, upon which Discover hung up and claimed that they could not confirm that the UPS notary was who they were saying they were. By now, Discover had been holding my $500 for over 7 months. I never did receive approval to use my activated and personally funded Discover credit card. Stay away from Discover card.

    My capitol one card wonโ€™t give me credit for 1800.00 in payments iv made 1)@200.00 from 2/8/23 then from December toon 12/1. 300,12/5 200,12/31 300,1/5 &126.203, 2/5. 300 and never given credit to me Feb Iโ€™m credited from company refunded 148.&150 in Feb so in Mach balance is 300.00 no card now balance is over 500 and I make 25 monthly they are robbing me blind I want to sue them

      I didnโ€™t like Discover because of their high interest rates and moved to Capital One and now having been a long time customer with multiple CCโ€™s from them, this merger is more like a stab in the back for consumers.
