Capital One fraud claims class action lawsuit overview:ย

Capital One denies account holdersโ€™ fraud claims without conducting a โ€œproperโ€ investigation, a new class action lawsuit alleges.ย 

Plaintiff Leah Waltonโ€™s class action lawsuit claims Capital One โ€œmechanically rejectedโ€ her fraud claim relating to nearly $1,500 in alleged unauthorized debit card charges without performing a โ€œreasonableโ€ investigation.ย 

โ€œCapital Oneโ€™s superficial rejection of Plaintiffโ€™s bona fide fraud claim without conducting a proper investigation and the use of form denial letters without any written explanation or supporting documentation violates federal law,โ€ the Capital One class action says.ย 

Walton wants to represent a nationwide class and California subclass of Capital One checking account holders who were denied reimbursement after submitting a timely notice to the bank about one or more unauthorized charges on their account.ย 

Capital One fraud claims rejected by company despite lack of โ€˜factual findings,โ€™ class action claims

Walton argues Capital One, after denying her fraud claim โ€” which she alleges was backed by โ€œsubstantialโ€ factual proof โ€” issued form denial letters โ€œdevoid of any factual findings or documentation from its alleged investigation.โ€

โ€œIf a financial institution like Capital One denies a fraud claim, it must provide a substantive written explanation of its findings and must make the supporting documentation available to any consumer who requests it,โ€ the Capital One class action says.ย 

Walton claims Capital One is guilty of breach of contract โ€”including breach of the covenant of good faith and fair dealing โ€” and violating Californiaโ€™s Unfair Competition Law.ย 

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual, statutory and treble damages for herself and all class members.ย 

Capital One recently agreed to pay $16 million to put an end to claims the banker charged its account holders unlawful fees for returned check or ACH debit transactions.ย

    Yes l was definitely denied claimโ€™s that why l stop paying them all they have done is add unnecessary late fees to my account l feel that unfair because l told them to cancel my card long time ago in the early part of 2023 and they did the opposite.

    I have not had any issue with Capital One. Best Egg I have had same issue with and would like a class action against them. Continued to deny my dispute for Microsoft charges, never confirmed or provided me with anything. Forced me to pay under duress or affect my credit.

    Iโ€™m a Capital One customer also. Now after reading this and the customers complaints/comments itโ€™s sounds scary and like should I continue being their customer. Iโ€™m getting the feeling that I should cancel and get my money. God forbid something like this should happen to me and also my daughter because she also is a customer. WHAT SHOULD I DO. Any advice plz feel free to send it to me plz. God help all the people they screwed over. My deep prayers are with you all. Iโ€™m so sorry that happened.

      Capital One also closes accounts saying it was due to a purchase and then will not say what the purchase was. They tell you when you call they have the right it was in the document you signed. This is such a bad business and does not make a person feel like this is a credible business. They only seem to care about their bottom line and not the people giving them their business.

    I have recently submitted a claim for a charge for a membership service which I cancelled in March of 2024. I have a confirmation of cancellation from the online store, โ€œJust Fab.โ€ I wish to be allowed to follow up once I receive some kind of correspondence from Capital One.

    I am a capital one customer and this has happened to me twice when I have all my documents to show it wasnโ€™t authorized and still was rejected

      I have multiple accounts e with Capital One. I have problems with they abruptly closed an account I had for nearly 20 years. They told me that the overdrafts were never paid for 3 months but I had 9 checks come into the account. Then, I had CC account I paid in full and they they say it never got paid. They followed up with the statement we donโ€™t do money transactions on Friday after 9pm and wonโ€™t start again until Monday. They charged off a second account stating that never received the money. There was a weekly and monthly deposited to the account . Then, they deny claims all with proof of unauthorized charges, we donโ€™t have to give you any explanation as to why your claims are denied. We gave the funds already and we are taking them back at a later date. The company seems to take out the funds when there was no money in the account. This is a predatory practice in financial practices. If I could I would File suit for one hundred million for my self and restitution.

    Iโ€™ve had similar experiences with Capital One. They sent me an email requesting additional information, so I gathered everything and sent it to the email address they provided. I later received an email stating I never sent them the requested information so my claim was denied. I like Capital One but their Fraud Department needs an overhaul.

    I am a Capital One customer and I have been for 5 years and every time Iโ€™ve ever put a claim in with more than enough substantial proof theyโ€™ve denied it and never given me any paperwork supporting why they denied it but I had paperwork proving that it shouldnโ€™t be denied and they wouldnโ€™t even look at it. Please add me to this. Iโ€™ve lost a lot of money over their denials not just on debit cards but also on credit cards on things that I didnโ€™t and shouldnโ€™t have had to pay for. Again I actually had proof they wouldnโ€™t look at and they just took the companyโ€™s word and made me pay for things.
