Workers walking in shipyardA former ship repair worker who served as an electrician at the Guam Navy Ship Repair Facility for more than twenty years has filed a lawsuit against manufacturing companies that sold asbestos products used on U.S. Navy ships, which he alleges led to his exposure to asbestos and subsequent diagnosis with mesothelioma asbestos cancer.

The plaintiff, Eusebio J., named Plastics Engineering Co. (PLENCO) in his mesothelioma asbestos cancer lawsuit, alleging that the company manufactured and sold asbestos-containing thermostat plastic molding materials used on U.S. Navy ships. Rockwell Automation Inc., another company named in the lawsuit, allegedly manufactured and sold a slew of other asbestos-containing electrical equipment use on the ships, including controllers and switches, the lawsuit alleges.

According to Eusebio’s lawsuit, these companies “expressly and impliedly warranted that said asbestos products were of merchantable quality, properly designed, manufactured and reasonably fit and suitable for ordinary use in ship construction, ship overhaul, and ship refitting industries.”

However, Eusebio said, the use of these products on the job as a journeyman electrician led to him being exposed to a large quantity of asbestos dust and fibers during his years of work on several different U.S. Navy ships.

Unfortunately, in August 2018, Eusebio was diagnosed with mesothelioma asbestos cancer that had already affected his lungs, chest cavity, cardiovascular system and more, said his attorney.

Also included in the lawsuit is Eusebio’s wife, Marta, who filed claims for emotional distress and loss of consortium. Through the lawsuit, the couple seeks both compensatory and punitive damages.

Mesothelioma Asbestos Cancer

Asbestos is a mineral that, for years, was used in a slew of products, such as insulation, floor tiles, and much more. However, asbestos has since been classified as a carcinogen—that is, a substance capable of causing cancer, according to the U.S. Department of Labor.

Dangerous asbestos fibers can be inhaled through the lungs, which places people at risk of developing mesothelioma cancer, according to the Mayo Clinic. Greater exposure to asbestos (higher quantities and/or over a longer period of time) serve to increase this risk, but even a small amount of asbestos exposure poses a risk.
