Vitaminwater Deceptive Marketing Class Action Settlement Approved – An Ohio judge has preliminarily approved a class action settlement alleging Vitaminwater’spackaging and marketing deceives consumers into thinking the product is fortified with nutrients even though it is essentially just a sugary beverage. TheVitaminwater settlement will resolve several class action lawsuits that have been filed throughout the country.

La. Couple Files Asbestos Lung Cancer Lawsuit – A former Navy shipyard worker and his wife have filed an asbestos lung cancer lawsuit against several of the man’s former employers, alleging they negligently exposed him to asbestos. He was diagnosed with lung cancer in 2012. If you or a loved one were exposed to asbestos and developed lung cancer, mesothelioma, or cancer in the lining of the lungs, abdomen or chest cavity, you may be able to take legal action against the companies responsible.

Lenovo Ultrabook Wi-Fi Connectivity Class Action Settlement – A settlement has been reached in a class action lawsuit alleging Lenovo (United States) Inc. sold computers with a design defect that impacted their ability to connect to Wi-Fi networks. If you purchased a LenovoUltrabook computer, you could be entitled to benefits from the class action settlement.

Pfizer Hit with Zoloft Birth Defects Lawsuit – A Tennessee woman filed a Zoloft lawsuit against Pfizer Inc. for the birth defects sustained by her daughter. The plaintiff alleges Zoloft caused the birth defects and other conditions her daughter currently suffers, and says she was unaware of the dangers of taking Zoloft during pregnancy.

Honda CR-V Class Action Settlement Reached over Defective Door Locks – American Honda Motor Co. Inc. has reached a class action settlement with consumers who allege the automaker hid that its CR-V vehicle had a defective door lock mechanism so that it would not have to cover the repair. Owners or lessees of Honda CR-V vehicles may be entitled to reimbursement for repairs and other benefits from the class action settlement.

Studies: Benicar Could Cause Long-Term Gastrointestinal Damage – Recent studies suggest that misdiagnosed cases of celiac disease were actually side effects of Benicar and may have caused patients to suffer long-term gastrointestinal damage. Were you hospitalized for severe gastrointestinal problems after using Benicar? If so, you may have a legal claim.

$31M Bank of America Force-Placed Insurance Class Action Settlement Approved – A $31 million class action settlement between Bank of America NA and homeowners who allege they were illegally forced to purchase overpriced and excessive flood insurance has been preliminarily approved by a federal judge. In addition to offering compensation to Class Members, Bank of America has also agreed to make significant changes to its insurance practices.

Class Action Lawsuit Claims Baby Powder Causes Ovarian Cancer – A class action lawsuit claims that Johnson & Johnson’s Baby Powder is unsafe and that the women who use it are at a greater risk for ovarian cancer. The plaintiffs allege J&J has been aware of the link between talcum powder and ovarian cancer for more than 30 years but failed to warn consumers about the risk.

Water Contamination Class Action Settlement Medical Monitoring Program– A C-8 Medical Monitoring Program has been created as part of a class action settlement involving claims arising from the chemical contamination of drinking water released from a du Pont plant in West Virginia. If you consumed water from one of the affected water sources, you may be entitled to medical monitoring for certain diseases that have been linked to C-8 exposure.

Eli Lilly Hit with Cymbalta Lawsuits over Withdrawal Symptoms – Eli Lilly & Co. is facing close to 30 Cymbalta lawsuits alleging the drug causes consumers to experience antidepressant discontinuation syndrome. The plaintiffs allege Eli Lilly severely underestimated and underreported the real withdrawal incidence rate associated with Cymbalta. If you attempted to stop taking Cymbalta and suffered withdrawal symptoms, you may have a legal claim.

Update from the President and CEO of Top Class Actions 

Wow! What a week! End of the month is ALWAYS busy for me and September hasn’t disappointed! We’re working hard through a BUNCH of campaigns and my team is really finishing out the month strong. We’ve launched some new class action investigations, so make sure to see what you may qualify for and submit your information. A new investigation involving stockbroker fraud launched Monday, and we have a BIG one that affects pretty much every one in California who shopped at a Gap, Banana Republic, Old Navy or related store going up soon! Stay tuned for details.

On the home front we got SLAMMED with a storm on Saturday. The wind was so strong it was blowing the rain horizontally. This is especially bad for homes in the Southwest because we have tile roofs. The wind blew the rain straight under the tiles and caused it to pool on my patio roof which caused (or identified) two leaks in my house. Thankfully it’s Arizona so now we should be dry for a few weeks. Hopefully the repairs will be minimal.

The bright side of the storm is that the girls had a FANTASTIC time jumping in puddles! We let the first big rain from the storm wash away the oil and other assorted bad stuff, and an hour later when the next big wave came through it was puddle time! If you follow me on Facebook you got to see the river — I mean road — in front of my house during the first big rain, and then the girls playing in the rain when the second wave blew through. They loved it! I have to admit I had fun following them and stomping through puddles myself. We can never be TOO grown up right?
