Nelnet Call Recording Class Action Settlement – Student loan servicer Nelnet has agreed to settle a class action lawsuit alleging it illegally recorded telephone calls without notifying the recipient. If you received a call from Nelnet that was recorded without your authorization, you could be eligible for payment from the call recording settlement.

Man Files Medtronic Lawsuit Over Spinal Surgery Complications – An Arizona man has filed a bone graft lawsuit against Medtronic Inc., alleging that off-label use of the Infuse Bone Graft System caused him to suffer serious complications following spinal fusion surgery. He says he never would have consented to off-label use of the Infuse bone graft had he known about the risks.

Google to Issue Refunds for Kids’ In-App Charges under FTC Settlement – Last week, the Federal Trade Commission announced that Google agreed to pay a minimum of $19 million to settle allegations it unfairly billed consumers for children’s unauthorized in-app purchases. Under the terms of the settlement with the FTC, Google will provide full refunds to consumers who were charged for unauthorized in-app purchases made by children.

Unum Lawsuit Says Insurer Doesn’t Consider Brain Injury Disabling – Unum has been hit with a lawsuit alleging the insurer has denied a woman’s disability claim in bad faith. The plaintiff alleges she suffered a brain aneurysm that left her with debilitating headaches, memory problems and speech difficulty that rendered her unable to perform her job duties. However, Unum reportedly denied her disability claim and declared her fit for work, despite conflicting medical opinions.

College Faculty TIAA-CREF Retirement Account Class Action Settlement – A settlement has been reached in a class action lawsuit accusing retirement funds of profiting off of professors’ savings by delaying trades in violation of ERISA. If you had a TIAA-CREF account and were denied investment gains because a transfer or distribution of funds was not completed within seven days of your request, you may be entitled to payments from the class action settlement.

FDA Warns Consumers About Tylenol Extra Strength Liver Damage Risk – The U.S. Food and Drug Administration has issued two warnings this year about the risk of liver damage associated with high doses of Tylenol (acetaminophen). Many reports identify acetaminophen overdose as the leading cause of liver damage across the nation, allegedly causing thousands of hospitalizations and hundreds of deaths each year.

Iowa School Food Class Action Settlement – If you paid for school lunches at certain Iowa schools, you may be entitled to compensation from a class action lawsuit that accused educational associations of conspiring with food distributors to restrain the market for the retail sale of school foods. The deadline is approaching quickly, so find out if you qualify now!

Young Mother Dies from Stevens Johnson Syndrome – A young woman died after developing Stevens Johnson Syndrome (SJS), possibly as a reaction to antibiotics she was taking. SJS is a rare, life-threatening autoimmune reaction that has been linked to certain medications. If you developed SJS after taking a prescribed or over-the counter medication, you may be eligible to take legal action against the drug’s manufacturer.

Halliburton Reaches $1.1B Deepwater Horizon Oil Spill Settlement – Halliburton has agreed to pay $1.1 billion to settle the majority of the claims lodged against it following the 2010 Deepwater Horizon oil spill in the Gulf of Mexico. If the settlement is approved, Halliburton will compensate certain individuals, businesses and other entities that were affected by the oil or hydrocarbons in connection with the oil spill.

Ethicon Under Fire for Gastric Bypass Surgery Stomach Staples – Patients who had gastric bypass surgery have taken legal action against the manufacturers of the stomach staples used in their surgeries, alleging the companies made and sold defective products that failed to keep the suture lines closed. Ethicon has been manufacturing stomach staples since 1999 and has reportedly received numerous reports of staple line failures.

Update from the President and CEO of Top Class Actions

 

Good morning everyone! I hope you had a GREAT week! My beautiful bride and I got to get away for a long weekend to see some friends of ours get married in Portland, OR. It was a BEAUTIFUL wedding at an incredible winery. We made some new friends while we were there and had a super fantastic time. Sometimes it’s great to get a few days away from the kids and distractions to reconnect with my wife. It’s really valuable! Of course, I ended up working some while up here in Portland, but, we still made lots of time just for us. I also got to spend time with a very good friend of mine who also happens to be President and Founder of a class action settlement administrator. It was extremely valuable talking business strategy with a guy who built a company from $0, and was a waiter part time as he started the business, to a company doing more than $5 million in revenue this year. Incredible!

Portland is such a beautiful city and we may try to spend some time up here next summer to get out of the Phoenix heat. The green trees, grass and beautiful mountains really took us into a whole new world. I have more team members in the Portland area than Phoenix, so it makes good business sense as well!

That’s all for the letter from me today. We are about to hop in the car and head to the airport to fly home. The news is saying we’re coming back to a drenched backyard and flooded freeways in Phoenix. Hopefully they will be clear by the time we land! Stay dry Arizona friends!
