This is the latest Early Termination Fee (ETF) class action lawsuit settlement. The AT&T Mobility / Cingular Wireless ETF (Early Termination Fee) class action lawsuit settlement provides more to claimants, and provides a much longer window of time to submit your claim, so it's possible that it won't be challenged or held up as long. This, along with other ETF (Early Termination Fee) class actions are being settled by all of the largest wireless carriers. So, why are all of the wireless carriers settling the class action lawsuits involving their Flat Rate Early Termination Fees?
The largest wireless carriers are all settling these class action lawsuits because they charged Flat Rate ETFs (Early Termination Fees.) It didn't matter if you had one month left in your contract, if you canceled you were charged hundreds of dollars. Obviously this is unfair. Early on in the cases the wireless/cellular carriers argued that they lost money on each customer who canceled early because of the low amounts they charged for the wireless/mobile phones. This argument makes sense for those who canceled their wireless service early in their contract, but, not for those who canceled their service at the end of the contract. Thus, most wireless carriers still charge an ETF (Early Termination Fee) but now it decreases the longer you're a subscriber. That way those who cancel near the end of their contract aren't charged the same as those who cancel early on.
