Details: The initial class action settlement paperwork is showing that this may be a good, and easy to claim, settlement to claim. Dannon's Activia Yogurt, and DanActive Yogurt Drinks are involved in this class action lawsuit settlement. This settlement allows consumers who purchased Dannon Activia Yogurt or the DanActive drink to submit a claim and receive some cash back. If you submit an online claim (no proof of purchase required) the maximum you'll receive back is $15. If you submit a signed, paper claim form through the mail, your max is $30. Who doesn't love Yogurt? It's good, and good for you! No one is disputing that fact. In this class action the dispute seems to arise from claims that Dannon Activia yogurt and DanActive yogurt are "clinically proven" to help your digestive system. While some of the ingredients in Dannon Activia and DanActive yogurts are show to have a posivite effect on the immune system we weren't able to find any independent clinical studies which show that the Dannon product itself has this effect.
That's why these types of class action lawsuits are getting settled. Unless you have performed an independent, heavily verified, clinical study it's typically unlawful to claim that your product helps your body in a specific way. In addition, if you are going to make these claims, often times they need to be approved by the FDA. While the claims may help sales they tend to mislead the consumer buying the product. Now, lets get serious, a $35,000,000 class action settlement to Dannon is just a drop in the bucket when it comes to Activia sales and won't hurt them much (though it sure will get the point accross!) If you purchase Activia yogurt, make sure to submit your claim! Don't miss out, especially since online claims are accepted
