Details: Volkswagen has reached a class action lawsuit settlement over allegations it misrepresented the characteristics of the Bluetooth system in certain 2010 VW Jetta and VW Golf models. As a result, anyone who purchased or leased one of the following 2010 Jetta or 2010 Golf models will be entitled to receive either a cash reimbursement or free installation of a Bluetooth upgrade kit.
The Volkswagen Bluetooth settlement will resolve a class action lawsuit, entitled Christensen, et al. v. Volkswagen Group of America, Inc., that alleges Volkswagen’s advertising and product descriptions misrepresented the characteristics of the Bluetooth systems in certain model year 2010 VW Jetta Sedans, Jetta SportWagens, and VW Golfs.
Volkswagen denies the allegations, but has agreed to enter into a class action lawsuit settlement to avoid ongoing litigation.
Class Members of the Volkswagen Bluetooth class action settlement include anyone in the U.S. and Puerto Rico who purchased or leased, not for resale, the following vehicles: 2010 Volkswagen Jetta Sedans (in trim levels Limited, SE, and Wolfsburg); 2010 Jetta SportWagens (in trim levels SE and TDI); 2010 Golfs (in trim level TDI); as well as 2010 Volkswagen Jetta Sedan S, Jetta SportWagen S and Golf 2.5 vehicles originally purchased or leased with the Bluetooth option.
Class Members who submit a valid claim form by March 27, 2012 will receive one of the following benefits from the VW Bluetooth class action lawsuit settlement:
(I) Reimbursement of costs for Class Members who already upgraded their vehicle’s Bluetooth system: Volkswagen will reimburse you for the purchase price of a Volkswagen 9W3 or 9W7 Bluetooth module, plus labor and shipping costs, as long as it was purchased prior to January 12, 2012 to achieve a higher level of Bluetooth functionality than the 9W2 module that came with the Settlement Class Vehicles. To receive this benefit, you must submit a claim form executed under penalty of perjury, along with an itemized receipt showing a date and itemization for the purchase of module itself, as well as any claimed labor or shipping charges, by the deadline of March 27, 2012. No claims for reimbursement will be accepted for reimbursement of costs incurred at any time after January 12, 2012.
(II) Installation of Bluetooth Upgrade Kits: If you do not submit a claim for reimbursement, Volkswagen will pay to have a Bluetooth Upgrade Kit installed at an authorized Volkswagen dealership at no cost for parts or labor, as long as you submit a claim form executed under penalty of perjury by the deadline of March 27, 2012.
