Ford Diesel Engine Class Action Settlement Delayed by Appeals
By Mike Holter
UPDATE: All appeals have been resolved and the settlement is now final and effective. See how to file a claim for the Ford Diesel Engine Class Action Lawsuit Settlement.
Payouts from the Ford diesel engine settlement have been delayed pending two appeals that were filed after the Court approved the class action settlement on July 2. The settlement cannot become effective until the appeals are resolved.
Class Members David Stevens, Robert Burress and Michael Neill filed the appeals, but court documents did not show what the basis of their appeals were. The Ford diesel engine class action settlement will allow Class Members to claim between $50 and $825 for reimbursement of post-warranty repairs to certain engine components or deductibles.
The proposed Ford diesel engine settlement will resolve dozens of class action lawsuits, consolidated as In re: Navistar 6.0L Diesel Engine Products Liability Litigation, that claim the PowerStroke diesel engines installed primarily in heavy-duty Ford trucks and vans contains defects that result in poor performance and expensive repair bills.
Class Members include all current and former owners/lessees of a 2003-2007 non-ambulance Ford vehicle equipped with a 6.0-liter PowerStroke diesel engine that received one or more of the following repairs covered by Ford’s New Vehicle Limited Warranty during the vehicle’s last five years in service or 100,000 miles, whichever comes first:
- Fuel injector
- Exhaust gas recirculation valve (“EGR”)
- EGR cooler
- Oil cooler
- Turbocharger
Claim Forms will not be available until after the appeals are resolved and the settlement becomes effective. The Settlement Administrator is advising Class Members to check for an update on the status of these appeals on September 20, 2013.

Big companies like Ford always has something up their sleeves. It is not surprising why they have been granted the appeals even when the reasons for such appeal were not so clear.
