Georgia Man Sues Pharmaceutical Giant for Tylenol Liver Damage

By Amanda Antell

Tylenol Drug LawsuitGeorgia plaintiff Jonathon Eric Tyler is suing the pharmaceutical giant Johnson & Johnson and its affiliated companies, McNeil Consumer Healthcare and Amneal Pharmaceuticals, for the injuries he allegedly sustained from their over-the-counter medication Tylenol. The plaintiff is claiming that he suffered acute liver failure after taking Tylenol in combination with a generic version of Vicodin.

According to the Tylenol lawsuit, Tyler was hospitalized on June 1, 2011 where it was discovered that he was suffering from acute liver failure. Tyler claims that he took both medications according to the exact instructions on the bottles, and even consulted his physician about taking both medications at once. Tyler says that both of these medications were for therapeutic purposes to relieve undisclosed pain he had been suffering.

When it was discovered that he was suffering from liver failure, Tyler sought legal action against the pharmaceutical companies. According to his Tylenol lawsuit, at no point in time was he or his physician aware of the possible side effects that may have occurred in taking these medications by themselves or in combination. Tyler believes that Tylenol is primarily responsible for his liver failure. He claims that he was unaware that he may develop acute liver failure from taking the medication. Tyler states that had he known about this possibility, he never would have taken it.

Overview of Tylenol Liver Complications

The active ingredient in Tylenol, acetaminophen, is suspected to be the cause of liver damage in patients. While it is unknown what exactly causes the liver failure, various studies have concluded that ingesting medications with acetaminophen in large amounts significantly raises the chances of acute liver failure. Additionally, it was found that these chances rise even higher if this medication is taken with alcohol or in conjunction with another medication. Roughly 200 people die each year from Tylenol liver failure, with 56,000 emergency room trips attributed acetaminophen overdose.

Tylenol was initially approved in the 1970s, and has been around for generations as a reliable over-the-counter pain medication. However, as early as the 1990s, it was suspected that the medication may have caused liver problems for patients. Despite the amount of concern, it wasn’t until earlier this year that it was announced that Johnson & Johnson would update the label for Tylenol to include possible liver failure.

Tylenol Litigation Movement

Every year, Tylenol earns more than $1 billion in sales, making it one of the most widely used medications in the United States. Tyler and thousands of other plaintiffs across the country are suing this company for the inadequate labeling of Tylenol, which they claim failed to warn them of possible liver failure. Tyler is seeking damages for negligence, pain and suffering, medical compensation and punitive damages. Due to the large number of plaintiffs filing Tylenol liver damage lawsuits, the cases have been consolidated into multidistrict litigation (MDL) in Pennsylvania federal court.

The Tylenol liver damage MDL is In Re: Tylenol (Acetaminophen) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2436, in the U.S. District Court for the Eastern District of Pennsylvania.
