New Yasmin/Yaz Lawsuit Claims Severe Blood Clot Complications

By Kimberly Mirando

Yasmin/Yaz blood clotA new Yasmin/Yaz lawsuit has been filed against Bayer in Illinois federal court by two women who claim they suffered deep vein thrombosis, pulmonary embolism, gallbladder removal and other Yaz injuries as a result of using Yaz/Yasmin oral contraceptive. The Plaintiffs are seeking over $75,000 in compensatory damages as well as medical expenses and attorneys’ fees in the Yaz/Yasmin lawsuit.

Plaintiffs Andrea Banes and Erin Weiser allege in Yaz lawsuit that they suffered severe side effects from taking the oral contraceptive, including Yaz blood clots that led to deep vein thrombosis, pulmonary embolism, gallbladder disease and more. The women allege there were defects in the manufacturing, design and warnings provided for Yaz/Yasmin, which has been linked to a high risk of developing blood clots, stroke and heart attack. Their Yasmin lawsuit alleges there is insufficient data available to support the safe use of estrogen and progestin combined oral contraceptives like Yasmin/Yaz over other birth control pills, but that Bayer not only ignored the increased risks of harm but chose to urge consumers to use Yaz/Yasmin over other safer alternatives. The women allege in the Yaz/Yasmin lawsuit that Bayer committed fraud in continuing to market Yaz/Yasmin as “just as safe” as other birth control products, and that the product breaches both express and implied warranties. The women’s husbands, Randall Banes and William Weiser, are also named as Plaintiffs, and claim they lost the company and society of their spouses as a result of the Yaz injuries they suffered.

The couples’ Yaz lawsuit joins hundreds of other similar Yaz/Yasmin lawsuits filed by patients that also experienced complications from dangerous Yaz side effects. Many of these cases have been consolidated in the ongoing and growing Yaz/Yasmin multi district litigation case currently pending in the U.S. District Court for Southern Illinois, entitled Yasmin and Yaz (Drospirenone) Marketing, Sales Practices and Products Liability Litigation.

Yasmin/Yaz Lawsuit MDL

The Yasmin/Yaz lawsuit MDL allows thousands of Yasmin and Yaz users to file lawsuits under the jurisdiction of one judge, retain their own attorney, and receive an individual award if the case is won or settled. If an MDL settlement is reached, the award they would receive is typically much larger than any individual award expected in a Yasmin/Yaz class action lawsuit. For example, in a Yaz class action lawsuit, hundreds of thousands of Yaz users are joined together. Once, or if, a Yaz class action settlement is reached, the Yaz class members would typically share the award and the award may be in the range of thousands of dollars per claimant, rather than tens of thousands, hundreds of thousands, or even millions of dollars in some cases for individual Yaz lawsuits.

On the other hand, if the Yasmin/Yaz lawsuit MDL settles, everyone who joined the MDL would receive any financial award individually, unlike in a class action lawsuit. The Yasmin/Yaz lawsuit MDL lawyers will determine exactly what each Plaintiff will receive depending on the injury suffered. This may mean that those who file Yasmin/Yaz wrongful death lawsuits due to heart attack or stroke will receive more than those who successfully removed blood clots from their system. The Yasmin/Yaz law firms litigating the MDL will determine this as the case progresses.

Yasmin/Yaz Side Effects Cited in Lawsuits

Thousands of women have filed lawsuits against the makers of Yaz and Yasmin, alleging they suffered serious side effects, including:

* stroke
* pulmonary embolism
* blood clots
* heart attack
* gallbladder disease
* deep vein thrombosis (DVT)
Women who have suffered Yaz/Yasmin side effects are suing Bayer alleging they should have been warned of the severe and deadly side effects of these birth control drugs. If you are experiencing these Yasmin/Yaz side effects, you should see a doctor immediately. You should also speak with a Yasmin/Yaz blood clot specialist to see if you are a good fit to file a Yasmin/Yaz class action lawsuit or an individual Yasmin/Yaz lawsuit. Bayer has already settled $142 million worth of lawsuits alleging that Yasmin and Yaz birth control pills caused blood clots in women.
