Actos Bladder Cancer Lawsuit Includes Loss of Consortium Claim by Spouse

Monte Dallas took Actos to treat her type 2 diabetes and was not warned of the risk of developing bladder cancer for Actos users. After developing bladder tumors and being diagnosed with Actos related bladder cancer Monte and her husband filed the Actos side effect lawsuit. Recent studies have shown that long term Actos users increase their risk of bladder cancer by up to 83% compared to those who don’t take Actos or take it for less than a year. Monte’s husband, James, is on the Actos bladder cancer lawsuit as a co-plaintiff, suing Takeda Pharmaceuticals for “loss of consortium” with his wife due to Actos bladder cancer and the treatment of her cancer.
Monte started taking Actos in May, 2007 as part of prescribed diabetes treatment. Neither Monte or her prescribing physician were warned of the risk of developing bladder cancer for users of Actos. In May, 2010, Monte stopped using Actos once she was diagnosed with cancerous bladder tumors.
Monte opted to file her Actos bladder cancer lawsuit individually and not as part of the Actos bladder cancer lawsuit multidistrict litigation (MDL.) The Actos bladder cancer lawsuit MDL allows thousands of Actos users to file lawsuits under the jurisdiction of one judge but each Actos plaintiff retains their own attorney and will receive an individual award if the case is won or settled. The award they would receive is typically much larger than any individual award expected in an Actos bladder cancer class action lawsuit. The Actos bladder cancer lawsuit MDL is similar to an Actos bladder cancer class action lawsuit but different in that one key aspect. In an Actos class action lawsuit hundreds of thousands of Actos patients are joined together. Once or if the Actos bladder cancer class action lawsuit settles the Actos users would typically share the award and the award may be in the thousands of dollars range, rather than tens of thousands, hundreds of thousands, or even millions of dollars in some cases for individual Actos bladder tumor lawsuits. Everyone who joins the Actos bladder cancer lawsuit MDL, and if the MDL settles, would receive any financial award individually unlike an Actos class action lawsuit. The Actos bladder cancer lawsuit MDL lawyers will determine exactly what each plaintiff will receive depending on the injury suffered. This may mean that those who file Actos wrongful death lawsuits will receive more than those who successfully undergo cancer treatment and recover from bladder cancer. In fact, the FDA didn’t come out with a warning connecting Actos to bladder cancer until 2011, even though Takeda Pharmaceuticals allegedly knew of the risks years before the FDA issued the warning. Monte and James Actos bladder cancer lawsuit states the she wouldn’t have taken Actos if she knew of the risk of developing cancerous bladder tumors.
Anyone who uses Actos needs to know the symptoms of bladder cancer and bladder tumors so it can be caught and hopefully treated without resulting in death. Bladder cancer symptoms include tumors which may cause blood in the urine, painful or frequent urination, or straining during urination. In addition, other common signs of bladder cancer include fatigue, incontinence, weight loss and bone pain or tenderness.
