Man Took Actos 9 Years, Develops Bladder Cancer and Dies. Family Files Wrongful Death Lawsuit.

By Scott Hardy

Actos Pills Cause Bladder Cancer Allege LawsuitsThe daughter of a man who took Actos (pioglitazone) for eight years, developed bladder cancer, and then died due to alleged unpublished side effects of Actos (pioglitazone,) filed an Actos wrongful death lawsuit against Takeda Pharmaceuticals. The latest Actos wrongful death lawsuit was filed by Diana Jean Taylor. Diana’s father, Virgil Mason McCallister, took Actos (pioglitazone) to treat his type 2 diabetes.
Diana filed the Actos wrongful death lawsuit in Cook County, Illinois rather than under the Actos bladder cancer multidistrict litigation (MDL) in Louisiana. The Actos bladder cancer lawsuit MDL allows thousands, and possibly tens of thousands, of Actos users to file bladder cancer lawsuits under the direction of one judge and a steering committee of plaintiff and defense attorneys. One of the benefits of filing an Actos bladder cancer lawsuit under the MDL rather than filing an Actos bladder cancer class action lawsuit is that those who file as part of the Actos bladder cancer lawsuit MDL maintain separate claims so they receive their own award once the Actos lawsuit is won or settled. The Actos bladder cancer lawsuit MDL is similar to an Actos bladder cancer class action lawsuit but different in that one key aspect. The Actos bladder cancer class action lawsuit automatically includes hundreds of thousands of Actos users if it is approved by a federal judge, but, if the Actos class action lawsuit settles each Actos user will most likely share the award (if they submit their Actos class action lawsuit settlement claim form on time.) Everyone who joins the Actos bladder cancer lawsuit MDL will receive any financial award won or settled individually unlike any kind of Actos bladder cancer class action lawsuit settlement.
Diana’s Actos wrongful death lawsuit states that her father Virgil started taking Actos in 2000 to help treat his type 2 diabetes. Virgil took Actos for approximately eight years before developing bladder tumors allegedly caused as a side effect of Actos. Virgil passed away from complications related to Actos cancerous bladder tumors in 2009. It’s important to note that the FDA didn’t issue a warning connecting bladder cancer to Actos until June, 2011, approximately two years after Virgil died. Diana’s Actos bladder cancer wrongful death lawsuit alleges that Takeda Pharmaceuticals didn’t warn her father, or his doctor who prescribed Actos, of the risk of developing bladder tumors and cardiovascular problems. Diana’s Actos bladder cancer wrongful death lawsuit states that Virgil would not have decided to use Actos if he knew of the heightened risk of developing cancerous bladder tumors.
It’s important that Actos users are aware of the symptoms of bladder tumors and bladder cancer. Typical signs of bladder cancer include tumors which may cause blood in the urine, painful or frequent urination, or straining during urination. In addition, other common signs of bladder cancer include fatigue, incontinence, weight loss and bone pain or tenderness. If you are experiencing these symptoms you should see a doctor immediately so bladder cancer or tumors can be ruled out or cancer treatment started if necessary. Bladder cancer treatment may include surgery to remove any cancerous tumors within your bladder. If you are experiencing these symptoms and are diagnosed with bladder cancer or tumors you should speak with an Actos bladder cancer attorney to see if you are a good fit to file an Actos class action lawsuit or an Actos personal injury lawsuit. Diana’s Actos bladder cancer wrongful death lawsuit is seeking a financial award in excess of $75,000. In fact, if successful wrongful deaths lawsuits can net the plaintiff more than a million dollars if the case goes to trial.
There is no mention of a spouse in the Actos bladder cancer wrongful death lawsuit. In cases where an Actos user develops bladder cancer and is married the spouse may be able to file a lawsuit alleging “loss of consortium” due to their spouse’s injuries from Actos. “Loss of consortium” is a legal term for the loss of intimacy between a couple due to the injuries the plaintiff suffered (in this case bladder cancer.)
