Uponor class action settlements have been reached in two lawsuits alleging the company’s high-zinc-content brass plumbing fittings are defective and break down prematurely. Consumers who own or owned property in the United States that contains high zinc content brass plumbing products could be eligible for benefits from the Uponor class action lawsuit settlements.

According to the class action lawsuits, Uponor yellow brass fittings and components made from high-zinc-content brass were defectively designed and prematurely corrode when drinking water runs through them, a chemical process known as “dezincification.” When the high zinc content brass pipes are exposed to water over time, they allegedly can become blocked, weep or seep, potentially causing leaks or other issues that can affect the water supply or cause property damage.

High-zinc-content brass is primarily made of copper and contains at least 30 percent zinc. The Uponor yellow brass fittings named in the class action lawsuits were made of UNS C36000, C3770 or C35330 brass or similar copper alloys. They were used as components of the Uponor/Wirsbo PEX system.

The defendants deny the allegations and believe they acted responsibly with regard to supplying, selecting, using and installing the plumbing products. However, they have agreed to settle the class action lawsuit settlements to avoid the expense and uncertainty of trial.

Class Members who wish to exclude themselves from the Uponor high-zinc-content brass plumbing products class action lawsuit settlements must do so no later than Aug. 19, 2015.

Who’s Eligible

Class Members of the nationwide Uponor pipe-fitting lawsuit settlement include anyone who owns or owned buildings located in the United States that were built on or after Jan. 1, 2002, and which contain (or contained) Uponor yellow brass fittings.

Class Members of the Nevada Uponer pipe-fitting settlement include anyone who owns or owned buildings with the Uponor yellow brass fittings in the Las Vegas Valley.

If you are unsure whether your building contains the brass pipe fittings that would qualify you for benefits from this class action settlement, you can look inside your electrical panel for a yellow sticker that say “Uponor,” “Wirsbo” or “Aquapex.” Alternatively, you may hire a plumber to identify your plumbing (though you will be responsible for payment of these costs). If you do hire a plumber, make sure you keep a copy of all documentation (such as color photos) to confirm the products are present.

Potential Award

The defendants have agreed to pay a maximum of $21 million to settle the nationwide class action lawsuit, and a minimum of $7 million to settle the Nevada class action lawsuit. This money will be paid into a settlement fund that will be used to reimburse eligible Class Members for repairs or replacement costs relating to leaks or flow issues, and related property damage.

The amount each Class Member will receive depends on the type of claim they have. The defendants have agreed to pay a maximum of $60,000 per claim for property damage claimants in the nationwide lawsuit settlement, and up to $150,000 per claim in the Nevada settlement.

Uponor will also provide an extended warranty for eligible claims.

Proof of Purchase

Class Members must provide documentation that they have the Uponor high-zinc-content piping installed in the building. They may submit physical evidence, such as the Uponor yellow brass fittings, or other documentation that the Uponor pipe fittings were installed in the building. Photographs, an inspection report or a notorized plumber’s report can be submitted as proof that the Uponor yellow brass fittings were installed in the property.

Claim Form Deadline

Varies. If you previously had property damage, you must file a claim within six months after the class action settlement is approved. If the property was located in Clark County, Nevada, you must file a claim within 12 months of the property damage.

Similarly, people who experience property damage in the future must file a claim within six months after the damage occurs. If the property was located in Clark County, Nevada, the claim must be filed within 12 months of the property damage.

The Claims period will run for five years from when the nationwide Uponor class action lawsuit settlement is approved, and eight years from when the Nevada Uponor class action settlement is approved.
