Waste Away Group Settlement

Waste Away Group Inc. has agreed to settle a class action lawsuit alleging it engaged in improper pricing or contracting practices. If you entered into a written contract with Waste Away Group or one of its affiliates for commercial solid waste and/or recycling collection services in Alabama, you could be eligible for a cash payment from the class action settlement.

Plaintiff Dorothy Williams d/b/a Dot’s Restaurant filed the class action lawsuit against Waste Away Group in 2012, alleging the company engaged in improper practices related to the methods of establishing its base-rate price increases, fuel surcharges, and environmental and administrative charges/fees in connection with its waste and/or recycling collection services. By engaging in these practices, the class action lawsuit alleges, Waste Away Group breached its contracts with its customers.

Waste Away Group denies any wrongdoing but agreed to settle the class action lawsuit to avoid the cost and risk of trial.

Who’s Eligible

Class Members of the Waste Away Group settlement include: “All Open-Market Commercial Customers in Alabama who were Parties to a written Commercial Service Agreement with Waste Away Group, Inc. or its affiliates at any time between January 1, 2006 and December 31, 2013.”

Potential Award

Varies. According to the Class Notice, it is expected that each Class Member who does not opt out of the class action settlement will receive a payment proportionate to the length of time the Class Member has been a customer of Waste Away Group, multiplied by the number of locations where it received service.

Tier 1: Each Class Member who was a customer of WAG for more than six years (73 months or more) between Jan. 1, 2006 and Dec. 31, 2013 will receive approximately $120 per service location.

Tier 2: Each Class Member who was a customer of WAG for a period of more than four years and less than six years (49 to 72 months) between Jan. 1, 2006 and Dec. 31, 2013 will receive a payment of approximately $80 per service location.

Tier 3: Each Class Member who was a customer of WAG for a period no greater than four years (up to 48 months) during the period between Jan. 1, 2006 and Dec. 31, 2013 will receive a payment of approximately $30 per service location.

Claim Form Deadline

N/A. Class Members will automatically receive benefits from the class action settlement if it is granted final approval. If you did not receive notice of the Waste Away Group settlement but you believe you are a Class Member, contact the Settlement Administrator for assistance.

If you wish to exclude yourself from the Waste Away Group settlement, you must notify the Settlement Administrator by U.S. mail or complete an online notification form (available on the settlement website). NOTE: The request for exclusion must be received no later than May 29, 2015.
