Capital One Bank (USA) NA has agreed to settle a class action lawsuit concerning the policies of its 0% Access Check or No Hassle Check promotions. If you used a 0% Access Check or No Hassle Check on your Capital One credit card, you may be entitled to cash benefits from the class action settlement.
The 0% Access and No Hassle checks are checks that are mailed to Capital One credit card customers offering a 0% APR for a certain period of time in exchange for an upfront fee. The Capital One class action lawsuit alleges the bank’s policies and practices with regard to charges imposed after a customer uses these checks are deceptive, constitute a breach of contract, and violate the Truth in Lending Act (including the Credit Card Accountability Responsibility and Disclosure Act of 2009).
Capital One denies the allegations but has agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Capital One class action settlement received preliminary approval in December 2014.
UPDATE: On Feb. 5, 2016, the Capital One 0%Â Settlement website announced that replacement checks were mailed on Dec. 18, 2015 to all Class Members whose original checks were not cashed. If you received a postcard check from the Murr v. Capital One Settlement Fund in August of 2015, that check is expired and a new check was mailed to you in December of 2015.
Who’s Eligible
Class Members of the Capital One settlement include anyone who used a 0% Access Check or No Hassle Check on their Capital One credit card in the United States between Aug. 1, 2008 and Jan. 2, 2015.
Potential Award
$5.50 or $2.00, depending on the category the Class Member fits in.
Category 1: Customers who used only one 0% Check on an account and were charged interest on their purchase balance because of the 0% Check are entitled to receive an automatic payment of $5.50. Class Members who fall into this category do not need to file a claim. A check will automatically be sent once the settlement receives final approval.
Category 2: Customers who used more than one 0% Check on an account at least three months apart and were charged interest on their purchase balance because of the 0% Check are eligible to submit a claim to receive a $5.50 payment.
Category 3: Customers who used one or more 0% Checks but were not charged interest on their purchase balance because of the 0% Check are eligible to submit a claim to receive a $2 payment.
NOTE: If you did not receive an email or postcard notice of the Capital One class action settlement (including an 8-digit Notice ID number), you must download the Claim Form and mail it to the Settlement Administrator, postmarked no later than July 1, 2015.

I received a check for $5.50 and cashed it at my bank but a debit was taken from my account because there was no routing number nor accounting number on the check. Anyone else have this problem?
Received my check for 5.50 last week. Wowweee I can not go out to lunch on Capital One. lol.
They said that checks were mailed out on 8-25-2015, yet no one has reported of getting one. What is the hold up!!!
