Airgas USA LLC and Airgas Inc. have agreed to settle a class action lawsuit that alleges they violated the Fair and Accurate Credit Transactions Act (FACTA) by printing the expiration dates of payment cards on receipts. If you made a purchase from an Airgas retail store in the United States between April 4, 2011 and Aug. 28, 2012 using a personal credit or debit card, you may be entitled to a cash payment from the class action settlement.

Plaintiffs Mario Aliano and Nguyen Buren filed the class action lawsuit against Airgas, alleging the company violated certain requirements of FACTA. Specifically, their FACTA class action lawsuit alleges Airgas printed the expiration date of customers’ credit and debit cards on their receipts, which is a violation of FACTA. FACTA only allows either the last digits of the payment card number or the expiration date to be printed on a receipt, according to the Airgas class action lawsuit. The plaintiffs do not claim they suffered monetary damages from the alleged FACTA violation, but they are seeking statutory damages available under FACTA.

Airgas denies any liability but agreed to settle the FACTA class action lawsuit to avoid the cost of a trial.

Who’s Eligible

Class Members of the Airgas FACTA settlement include all individuals to whom Airgas or one of its affiliates provided an electronically printed receipt at the point of sale in a transaction that took place in the United States between April 4, 2011 and Aug. 28, 2012, and which receipt displays the expiration date of the individual’s personal credit or debit card.

N/A. To be eligible for benefits from the Airgas class action settlement, claimants’ names must be included on the list of eligible Class Members held by the Settlement Administrator.

Many Class Members have already received a notice in the mail that includes a Claim Number, which allows them to file a claim online. If you believe you are eligible for benefits from the Airgas FACTA settlement but did not receive a notice, you may submit your contact information to the Settlement Administrator for verification.
