Sony Computer Entertainment America LLC has reached a settlement with the Federal Trade Commission over allegations it engaged in deceptive advertising of the PlayStation Vita. Under the terms of the false advertising settlement, Sony has agreed to offer benefits to consumers who purchased a PlayStation Vita prior to June 1, 2012, and who have not returned the product for a full refund.
The FTC lawsuit alleged that Sony made false claims about the PlayStation Vita’s “cross platform gaming” or “cross-save” feature. According to the FTC, Sony made claims that PS Vita users could pause any game and continue to play the game on their PS Vita where they left off. However, this feature was allegedly available for only a few PS3 games and the cross-save capabilities varied between games.
Further, the FTC alleged that consumers who wished to use the cross platform gaming feature for certain games were required to purchase two versions of the game—one for the PS3 and one for the PS Vita. Consumers were also reportedly unable to engage in live, multiplayer gaming as promised.
The FTC also filed a false advertising lawsuit against Deutsch LA, which allegedly misled consumers by urging its employees to hype up the PlayStation Vita on social media without disclosing their connection to the advertising company. Further, the FTC alleged that Deutsch LA should have known that the advertisements it produced contained deceptive claims about the PlayStation Vita’s capabilities.
Sony has neither admitted nor denied liability, but agreed to settle the FTC lawsuit and offer benefits to consumers who purchased PlayStation Vitas before June 1, 2012.
Who’s Eligible
Consumers who purchased their PlayStation Vitas before June 1, 2012 and did not return the device for a full refund are eligible for benefits from the Sony settlement.
Potential Award
$25-50. Consumers may elect to receive either a check (or PSN account credit) worth $25 or a merchandise voucher that has a retail value of $50 or more.
Proof of Purchase
When submitting a claim for the PlayStation Vita settlement, consumers must provide one of the following:
- A store receipt showing the purchase of a PlayStation Vita before June 1, 2012; or
- A side panel of the PlayStation Vita package that shows the UPC code, SERIAL or SIRIS numbers; or
- Other information and materials that reasonably prove the consumer is an eligible purchaser of the PlayStation Vita before June 1, 2012.
Consumers should also be prepared to provide the SIRIS number or SERIAL number of the PlayStation Vita on the Claim Form.

I did not receive any refund after sending in my claim
I Signed The Perition Never Heard ANYTHING IM MOT TO HAPPY 25-50 DOLLAD VOUCHER The Machine WAS $400 AT LAUNCH!
I was a vita early adopter (Feb 2012). I filled out the form, mailed it with my receipt (Proof of purchase) and all other relevant information. I noticed that many people received the $25 psn credit from the settlement but I have not. Can I get clarification on if this process is complete or are Sony Vita customers still receiving them?
