eBay class action lawsuit

eBay Inc. has agreed to settle a class action lawsuit alleging it charged sellers with recurring listing fees that were not included in eBay’s disclosures. If you placed “Good Til Cancelled” (GTC) listings on eBay and were charged disputed fees, you may be entitled to benefits from the eBay class action settlement.

The Good Til Cancelled class action lawsuit alleges eBay did not properly explain to its users that the Insertion Fees and Optional Feature Fees for GTC listings would be charged on a recurring basis for 30 days. Further, the plaintiffs alleged that eBay should not have charged sellers Insertion Fees and Optional Feature Fees for Good Til Cancelled listings except at the time of the initial listing.

eBay denies the allegations but agreed to pay $6.4 million to settle the class action lawsuit. The eBay Good Til Cancelled settlement received preliminary approval on Jan. 29, 2015. An estimated 1.2 million sellers are eligible Class Members of the eBay settlement.

Who’s Eligible

Class Members of the eBay class action settlement include U.S. residents who placed “Good Til Cancelled” listings on eBay that commenced during the Class Period and were charged Disputed Fees.

For Stores Listings, the Class Period is from March 30, 2010 through June 19, 2012. For Core Listings and Motor Listings, the Class Period is from Sept. 16, 2008 through June 19, 2012.

Under the terms of the eBay class action settlement, “Disputed Fees” means the Insertion Fees and Optional Feature Fees incurred by Class Members after the initial 30-day listing period of a Good Til Cancelled listing, less any amounts already credited or refunded by eBay.

NOTE: Class Members of the eBay Good Til Cancelled settlement should have received a notice via email or postal mail service. If your eBay user ID or other account information has changed since Sept. 16, 2008, you will need to update your information on the settlement website.

Potential Award

Varies. The amount each Class Member is eligible to receive from the eBay class action settlement will be in proportion to the amount of Disputed Fees that the Class Member paid for Good Til Cancelled listings placed during the Class Period.

It is estimated that Class Members will recover approximately 9 percent of all disputed fees paid for GTC listings placed during the Class Period.

Class Members who have an active eBay account will automatically receive a credit to their account. Class Members who do not have an active eBay account will automatically receive a check to the address currently associated with the account. Class Members who have a closed eBay account and who did not receive notice of the class action settlement by mail or email must provide their current address information in order to receive payment.

If you have an active eBay account and your credit is greater than $2, you may request payment by check instead of an account credit. If you wish to request a check, you must do so no later than April 20, 2015.

    I Rcvd the post card in the mail about this eBay class action. Final hearing was in June 2015. Why have I not received any money? Or notification? Thank you.
