eBay class action lawsuit

A settlement has been reached in the eBay-Intuit employment class action lawsuit, which will resolve claims that eBay Inc. participated in illegal recruiting and hiring practices, thus violating California’s Sherman Act, the Cartwright Act, and the state’s Unfair Competition Law.

According to the eBay-Intuit employment class action lawsuit, eBay and Intuit maintained a “no-poach” agreement that would prevent either company from recruiting employees from each other. This agreement allegedly also prohibited eBay from hiring Intuit employees that approached the company independently.

Since this eBay-Intuit employment class action lawsuit was first filed by the Department of Justice Antitrust Division and the State of California in November 2012, eBay has attempted to dismiss antitrust claims several times with little success. Finally, in May 2014, eBay agreed to an antitrust class action settlement, which was given preliminary approval a few months later and will likely be granted final approval in February of this year. This employment class action settlement may potentially affect many eBay and Intuit employees.

Per the terms of the eBay class action settlement, the company will pay $3.75 million into an employment settlement fund to resolve the antitrust allegations. $2.375 million of the set settlement fund amount will be used to compensate eligible Class Members. An additional $300,000 of the eBay-Intuit settlement fund will go to the state antitrust/consumer protection account for allegedly harming California’s economy.

eBay has denied all liability in this employment class action lawsuit, but has agreed to settle in order to avoid the uncertainty and expense of continued litigation.

Who’s Eligible

You are a Class Member of the eBay-Intuit employment class action settlement if you were a resident of California between Jan. 1, 2005 and May 1, 2014, and if you worked for eBay or Intuit during that same Class Period.

According to the eBay employment class action settlement, the court and the involved parties have agreed to three Claimant Pools, which are as follows:

“Claimant Pool I: If you were employed by Intuit and were considered for, but not offered, a position at eBay during the Settlement Period, and have been identified as a member of Claimant Pool I, you will receive between $5,000 and $10,000, a prorated distribution from a pool of $200,000. There are approximately 40 persons in Claimant Pool I.

Claimant Pool II: If you were employed by Intuit and applied for, but was not offered, a position at eBay during the Settlement Period, and are not a member of Claimant Pool I, you will receive between $1,000 and $1,500, a prorated distribution from a pool of $950,000. There are approximately 950 persons in Claimant Pool II.

Claimant Pool III: If you were employed by eBay or Intuit during the Settlement period and are not a member of Claimant Pool I or Claimant Pool II, and your employment can be reasonably confirmed, you will receive between $100 and $150, a prorated distribution from a pool of $1,225,000.”

Proof of Purchase

To claim your portion of the eBay class action settlement, you must submit a complete claim form online or download and mail a claim form from the settlement website to the Settlement Administrator before the established Claim Form Deadline.

    Hi, I agree with you I filed within the deadline and never hear anything more nor did I receive any type of payment for the claim? I’ve tried following up to find out about it but got nowhere it would be really nice just to know what is going on or if the people involved will ever get anything.

    Whatever happened to this settlement? I filed a claim online on February 3, 2015 (before the deadline) and received an e-mail confirmation. I never heard anything further about the case, nor have I received a payment. I recently (April 19, 2016) sent an e-mail inquiring about the case, but have received no reply.
