Quicksilver settlementQuiksilver Inc. has reached a class action lawsuit settlement with California customers who were asked to provide their personal identification information while making an in-store credit card purchase. If you were asked to provide your postal address, e-mail address and/or phone number during a credit card transaction at a Quiksilver-owned store, you may be eligible to claim a free Merchandise Certificate from the class action settlement.

The Quiksilver settlement will resolve a class action lawsuit (Lerman v. Quiksilver Inc.) that accuses the company of violating California Civil Code section 1747.08.

Quiksilver denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the Quiksilver credit card settlement include all persons who, between October 7, 2009 and April 1, 2013, used a credit card to make a purchase at a retail or outlet store owned and operated by Quiksilver (including Quiksilver, Quiksilver Youth, Roxy, and DC) located in the State of California and whose personal identification information (including but not limited to postal address, e-mail address, and/or telephone number), was requested and recorded by the company.

If the class action settlement is approved and you submit a valid Claim Form, you are entitled to receive one of two types of Merchandise Certificates:

  • a Merchandise Certificate worth 30% off a single purchase of up to $100; or
  • a Merchandise Certificate worth $15 off any single purchase (with no minimum-purchase amount).

To receive a Merchandise Certificate for $15 off any single purchase, you must select only this option. The Company shall issue a Merchandise Certificate for 30% off a single purchase of up to $100 to all other Class Members who file a valid claim, including those who: (1) select the 30% off option; (2) request both types of Merchandise Certificates; (3) fail to elect the type of Merchandise Certificate desired; or (4) file multiple claims and elect different types of Merchandise Certificates.

The only way to receive a Merchandise Certificate from the class action settlement is to submit a valid Claim Form no later than September 9, 2013. Claim Forms and more information on your rights in the Quiksilver Store Class Action Lawsuit Settlement can be found at classaction.kccllc.net/qsb.

The case is Anna Lerman, et al. v. Quiksilver Inc., et al., Case No. BC447110, Los Angeles County Superior Court.
