Old Navy ZIP Code Settlement

Old Navy LLC, The Gap Inc. and Banana Republic LLC have agreed to settle class action lawsuits alleging they improperly asked customers at some of their stores to provide their ZIP codes when they made a purchase with a credit card. If you shopped at a California Old Navy, Gap Outlet or Banana Republic Factory Store and had your personal identification information requested and recorded when you paid with a credit card, you may be entitled to benefits from the ZIP code class action settlement.

The Gap ZIP code class action lawsuits alleged that California Old Navy, Gap Outlet and Banana Republic Factory Store locations unlawfully requested and recorded certain personal identification information, including but not limited to ZIP codes, from customers who used a credit card to pay for merchandise at the stores. The plaintiffs allege this conduct violated the Song-Beverly Credit Card Act of 1971.

The defendants deny that they engaged in any wrongdoing but agreed to settle the class action lawsuit to avoid the cost of a trial.

Who’s Eligible

Class Members of the ZIP code class action settlement include consumers whose personal identification information, including a ZIP code, was requested and recorded by a store employee when they paid with a credit card at the following California locations:

  • Old Navy brand stores, between Jan. 21, 2008 and Sept. 18, 2014;
  • Gap Outlet brand stores, between Feb. 14, 2010 and Sept. 18, 2014; and
  • Banana Republic Factory Store brand stores, between March 4, 2010 and Sept. 18, 2014.
Potential Award

$10 off merchandise voucher, usable at a California Old Navy, Gap Outlet or Banana Republic Factory Store location.

Proof of Purchase

Class Members must attest under the penalty of perjury that they were asked to provide personal identification information when making a purchase at a California Old Navy, Gap Outlet or Banana Republic Factory Store during the relevant Class Period (listed above).

    I went to old navy last month and one of the employees was very raises to my brother the employee ask if I needed any help and If I wanted to apply for an old navy card I said no and then I toll the employee but u can help my brother and the employees said( I don’t think he has papers )I was like omg really I was really offended by what he said

    Real world, hon if you still owe them money they will not close your aoncuct. You need to pay off your aoncuct before you can request that they close it, and you will need to do so in writing and enclose your cut-up card with the letter. This is for their security so that no one can try to use the card once the aoncuct has closed.If you don’t owe them anything, there’s nothing for them to charge finance and late fees *on* so it’s up to you to pay off your balance, I’m afraid. And if you don’t pay and they continue to charge you interest and late fees, you *will* start getting letters from credit collection companies. You don’t want this to happen, for one because it will go on your credit history record and you’ll have a very hard time (if at all) being able to get any kind of credit or credit card for several years, until your credit record has been clean.Best advice: pay off what you owe them.

    They ask that question in Las vegas nevada when we went on our trip. We live in pearl city, hawaii and we shop at an old navy in honolulu and waipahu, hawaii. So do we qualify for this too? I think there staff are trained to ask for a zip code and all employees keep track of it. We go there all time cause there prices are very reasonable.
