Details on how to file a claim for the Children’s Coldcalm class action settlement have arrived! If you reside in California and purchased Boiron Children’s Coldcalm between August 31, 2006 and September 3, 2013, you can claim a cash refund from the class action settlement.
The Children’s Coldcalm settlement will resolve a 2010 class action lawsuit (Delarosa v. Boiron Inc.) that accused Boiron of falsely advertising that its Children’s Coldcalm temporarily relieves common-cold symptoms.
Boiron stands by its advertising and denies it did any wrong, but has agreed to a class action lawsuit settlement to resolve the litigation. A federal judge preliminarily approved the class action settlement on May 31, and a Final Fairness hearing is scheduled for November 4, 2014.
Class Members of the Children’s Coldcalm settlement include all persons who purchased Boiron Children’s Coldcalm in the State of California for personal use between August 31, 2006 and September 3, 2013 and were a resident of California at the time of purchase.
Class Members can file a claim to receive one of the following benefits:
- Claims Submitted with Proof of Purchase in Form of a Receipt(s): will entitle you to a full refund of the amount(s) shown on the receipt.
- Claims Submitted with Proof of Purchase in Form of Product Package: will entitle you to a refund of the amount of $12.99 per product purchased if you swear under penalty of perjury that you purchased Children’s Coldcalm during the Class Period.
- Claims Submitted Without Proof of Purchase: If you are unable to provide Proof of Purchase but swear or affirm under penalty of perjury that you purchased Children’s Coldcalm during the Class Period, you may submit a claim for $8.00 per product, with a cap of $16.00 per household.
- Pro Rata Disbursement of $1,000: In addition to the relief above, each eligible Class Member who submits a valid Claim Form will receive a pro rata share of $1,000 in statutory penalties to be paid by Defendant.
The only way to receive a cash refund from the class action settlement is to submit a valid Claim Form online or mailed to the Settlement Administrator postmarked on or before September 3, 2013.
