A class action settlement has been reached in the Newsvine user earnings litigation and Class Members may be eligible for benefits.

Kathleen Wilke, a resident of Washington and Newsvine user, filed the user earnings class action lawsuit against the website Newsvine Inc., claiming the company violated Washington state law when it allegedly failed to pay Newsvine users the advertising revenue and referral earnings due to them per the Newsvine user agreement.

This user earnings class action settlement potentially benefits hundreds of Newsvine users who had more than $10 in unpaid advertising revenue and/or referral earnings accrued from July 4, 2012, through Dec. 13, 2012 and onward.

Newsvine Inc. denies all of Wilke’s allegations of wrongdoing, but in the interest of avoiding uncertainty of trial and further legal expenses, Newsvine has agreed to create a class action settlement fund for the allegedly affected users.

Who’s Eligible

You are a Class Member of Newsvine User Earnings Class Action Settlement if:

i) You are a registered user of the Newsvine website and your account was not terminated by the company or deleted by the user before Nov. 1, 2012;

ii) You visited Newsvine while logged into your account at least one time prior to Nov. 1, 2011; and

iii) You had unpaid advertisements revenue-sharing earnings present in your Newsvine account Feb. 6, 2013 and onward.

Potential Award

Varies.

According to the Newsvine user earnings class action settlement, the settlement amounts will vary from Class Member to Class Member.

180 Day Period: If you accrued earnings between July 4, 2012, and Dec. 31, 2012, (otherwise known as the 180-Day Period), were an Active User of Newsvine and accrued more than $10 in unpaid User Earnings (otherwise known as Referral Earnings) before or on Dec. 31, 2012, then as an eligible Class Member, you will receive full payment of all unpaid earnings accrued during the 180-Day period.

Outside of 180 Day Period: If you, as an Active Newsvine User, accrued more than $10 in unpaid User Earnings/Referral Earnings as of Dec. 31, 2012, then as a eligible Class Member, you will receive 50 percent of the unpaid earnings accrued before the 180-Day Period.

Additional Payment: As an Eligible Claimant, you will receive a share of an additional $5,000 set aside by Newsvine as an approximation of User Earnings/Referral Earnings accrued by active user from Jan. 1, 2013, through Feb. 6, 2013.

If you accrued $10 or less in unpaid User Earnings/Referral Earnings as of Dec. 31, 2012, you will not receive a portion of the settlement.

Proof of Purchase

You must complete and submit a Claim Form (online or in print) no later than 11:59pm Pacific Standard Time on October 29, 2014, in order to receive a portion of the settlement fund.
