A settlement has been reached in a call recording class action lawsuit that alleges that Bass Pro Outdoor World LLC, BPS Direct LLC and Bass Pro LLC recorded certain telephone calls received from or placed to California in violation of California law.
The Bass Pro call recording class action lawsuit was filed by a customer who claims the retailer recorded at least one telephone call in which he disclosed personal identification and financial information to a customer service representative. The plaintiff alleges he was not notified that the call would be recorded.
According to the call recording class action lawsuit, Bass Pro regularly recorded incoming and outgoing telephone calls without informing customers that the call would be recorded, in violation of the California Invasion of Privacy Act.
Bass Pro denies the allegations but has agreed to settle the call recording class action lawsuit to avoid the expense and uncertainty of ongoing litigation. The Bass Pro call recording settlement was preliminarily approved in August.
In addition to providing more than $4 million to Class Members, the call recording settlement also requires Bass Pro to change its business practices so that it will not record any inbound telephone calls from California area codes without notifying the caller that the call may be recorded. Court records indicate Bass Pro has not recorded outbound calls to California phone numbers since April 4.
Who’s Eligible
Class Members of the Bass Pro call recording settlement include: “All natural persons who, while present in California and using a telephone with a California area code, participated in at least one recorded telephone call to Bass Pro between March 14, 2012 and March 27, 2013 or at least one recorded telephone call from Bass Pro between March 14, 2012 and April 3, 2013.”
Potential Award
Varies. The Bass Pro settlement fund will be divided equally among Class Members who return timely and valid Claim Forms.
Proof of Purchase
Class Members must provide the telephone number(s) they used to communicate with Bass Pro between March 14, 2012 and April 2013 and affirm they spoke with a Bass Pro customer service representative while physically in California during the relevant time period.
