GM ignition switch recall class action lawsuit

General Motors has established a settlement program to compensate automobile accident victims who were injured or killed due to faulty GM ignition switches in certain GM vehicles. GM has agreed to compensate all claimants in the amount deemed appropriate by the Settlement Administrator. Under the agreed-upon terms of the GM compensation program, GM cannot reject the Administrator’s final determinations of eligibility and the amount of compensation. Eligible claimants could receive millions of dollars from the GM settlement program.

GM has recalled millions of vehicles due to an ignition switch defect in which the ignition could unexpectedly shift out of the “run” position and cause a partial loss of electrical power. The GM ignition switch defect allegedly resulted in airbags failing to deploy during crashes. GM has reported 13 deaths linked to the ignition switch defect. Claimants of the GM ignition switch settlement must be able to show the vehicle’s air bags failed to deploy during the crash.

Individuals who have already reached an ignition switch settlement with GM may participate in the GM compensation program and receive additional compensation, if eligible.

Who’s Eligible

To be eligible for compensation from the GM ignition switch settlement, claimants must either be (1) the individual who suffered physical injury in the accident or (2) the legal representative of the decedent or the individual physically injured in the accident.

Drivers, passengers, pedestrians or occupants of other vehicles who were injured in a crash involving one of the recalled GM vehicles are eligible to submit claims for the GM settlement program. The accident must have occurred prior to Dec. 31, 2014.

Eligible vehicles include:

  • Chevrolet Cobalt (Model Years 2005-2007)
  • Chevrolet HHR (Model Years 2006-2007)
  • Daewoo G2X (Model Year 2007)
  • Opel/Vauxhall GT (Model Year 2007)
  • Pontiac G4 (Model Years 2005-2006)
  • Pontiac G5 (Model Year 2007)
  • Pontiac Pursuit (Model Years 2005-2006)
  • Pontiac Solstice (Model Years 2006-2007)
  • Saturn Ion (Model Years 2003-2007)
  • Saturn Sky (Model Year 2007)

 

Eligible vehicles also include the following GM cars in which the ignition switch was replaced by a dealer or independent service center with an ignition switch bearing part number 103942423:

  • Chevrolet Cobalt (Model Years 2008-2010)
  • Chevrolet HHR (Model Years 2008-2011)
  • Daewoo G2X (Model Years 2008-2009)
  • Opel/Vauxhall GT (Model Years 2008-2010)
  • Pontiac G5 (Model Years 2008-2010)
  • Pontiac Solstice (Model Years 2008-2010)
  • Saturn Sky (Model Years 2008-2010)

Potential Award

The GM ignition switch settlement may provide a minimum of $20,000 to eligible claimants. Depending on a number of factors, including the victim’s age, severity of injury, earning capacity and life expectancy, some claimants could be eligible to receive millions of dollars from the GM injury settlement.

GM will pay a minimum of $1 million for deaths caused by the ignition switch defect.

Proof of Purchase

Everyone filing a claim for the GM compensation program must prove that the ignition switch defect in a recalled GM vehicle was the “proximate cause” of the physical injury or death in the accident, and that the airbag failed to deploy. Individuals filing claims for personal injury must submit documentation that the victim was either hospitalized overnight or received outpatient medical treatment within 48 hours of the accident.

    en las vacaciones de agosto fui con mi hermana y su bebé recién nacida y mi hijo de un año a la playa en mi HHR 2006 . Venía en el spressway como a 70km y de repente el carro se apago no aceleraba no frenaba .Entre en pánico X k venían muchos carros atrás de mi Gracias a mi Dios pude ahorillarme y puse el freno de mano kede in medio de la carretera y apague el carro y puse las intermitentes. Empecé a llorar y voltie a ver a mi hermana y a nuestros hijos todos estábamos asustados y los niños estaban lloré y lloré . Después de 5 minutos volví a encender el carro y jalo como si nunca fuera pasado . Preguntamos k a vía pasado y nos dijeron k probablemente puse un botón k es para k se vaya sólo el carro

    I have a 2003 Pontiac Grand Am and I did have problems with the ignition too. Thank God no serious injuries or accidents happened but is that a reason not being compensated for the danger we are facing every time driving our vehicles because of some big company’s negligence?!
    There was a time my car would stop running occasionally too, and then a couple years ago sometimes it wouldn’t start up and then it would. It took weeks for the mechanic to figure out the problem…the ignition. One time I was driving and the key got turned in the off position and the car kept running…scary stuff!

      My pontiac grand am did the staying on after being in the off position and key taking out the day before that i turned the car off and the lights didnt tuen off my neighbor dissconected the battery and i hoojed it up and went to pick my kids up turned the car off and it kept running took it to dealer and they said the recall is a piece for the key and they turned my car off and now the thing will not start because of it the key turns but will not start

    I have a Pontiac G6 Convertible, my problem is the ignition switch that don’t turn the car completely off, or it could be the gear (park )which causes my CD player not to turn off causing my battery to run. A message : “Changer Park ” comes up. And because no one can seem to advise what to do about it (dealers, service departments) a recall is necessary. I am concerned my car can may not be totally off and if it is a gear cause an accident to property or person. If someone knows what I am talking about please reply!

    I had a very bad problem with my ignition key on my Dodge Journey 2009, it would not start and left me stranded for hours. My mechanics all knew the problem and the Chrysler dealership said it was not a problem and charged me for a new key $287.00.

    Now once in awhile my car will just stop in the middle of the highway or I have to try again and again to start it up……My mechanics say it is a faulty ignition part and Chrysler says its not. I have witness’ to back up my claim…

    I tried to find out if the ignition was GM made and I guess it is not…. but the same problem as the GM occurs with my car.

    The 2001 Pontiac Aztec is also a problem car , my ignition switch went out while I was driving and the car cut off,this car is dangerous do not have money to buy another and it was s0ld to me from a dealer ship for 6000 thousand dollars. . Can I be part of this GM settlement?

    I had an 1999 Buick LeSabre and the airbags did not deploy when my nephew had a wreck. He stated that the steering wheel locked up and he could not turn it. He lost control and hit a tree. He broke his collar bone and busted his head and had to have some staples put in. I wish they would investigate more cars made by GM.

    They should add the Saturn SL series as well. I had a 99 SL2 with an ignition that never worked properly. Sometimes you could pull the key out and the car would remain running!!! I had a drunk driver pull out in front of me and I t-boned her going over 40 mph and the airbag never deployed and I am quite tall and banged my head on the ceiling pretty good. Not sure if the airbag would have made it better or worse but I know the cops said they couldn’t believe the airbag didn’t deploy with my whole front end smashed in.
