A settlement has been reached in a class action lawsuit alleging The Sherwin-Williams Company violated the Telephone Consumer Protection Act (TCPA) by sendingย unwanted text messages to consumers.
If you received a Paint Pro Alerts text message from Sherwin-Williams between Jan. 23, 2015 and April 13, 2015 after having previously texted โSTOPโ to short code 72468, you may be entitled to payment from the TCPA class action settlement.
Plaintiff Wade Burris alleges that he texted โSTOPโ to short code 72468 in order to unsubscribe from receiving the Paint Pro Alerts from Sherwin-Williams. According to the TCPA class action lawsuit, a software configuration error caused Burris and other Class Members to receive additional text messages after unsubscribing from the text subscription service.
Burris claims that the text messages that were sent after consumers unsubscribed from the service were in violation of the TCPA. Class Members reportedly received a collective total of 682 additional text messages during the Class Period.
Sherwin-Williams does not admit any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of litigation.
The Sherwin-Williams TCPA class action settlement received preliminary approval on Nov. 17, 2015.
Whoโs Eligible
Class Members of the Sherman-Williams TCPA settlement include all persons within the United States who received a Paint Pro Alerts text message on their cell phone from or on behalf of Sherwin-Williams between Jan. 23, 2015 and April 13, 2015, after previously texting โSTOPโ to short code 72468.
Potential Award
$307 per text (estimated).
If the Sherwin-Williams TCPA settlement receives final approval, each Class Member who does not opt out of the class action settlement will receive a check worth approximately $307 per text sent by Sherwin-Williams allegedly in violation of the TCPA during the Class Period.

N/A. There is no Claim Form for this class action settlement. Class Members who do not exclude themselves from the Sherwin-Williams TCPA class action settlement will automatically receive a check in the mail.
If you wish to exclude yourself from the TCPA settlement, you must do so no later than Jan. 29, 2016.
