Settlements have been reached in class action lawsuits related to pipe fittings and hurricane straps that were used in certain homes in the Ocean Pointe Project, located in the District of Ewa. If you own a home in the Ocean Pointe Project, you may be entitled to benefits from the class action settlements.
The settlement resolves allegations that PEX brass plumbing fittings and “L” shaped hurricane straps installed in certain Ocean Pointe homes were defective. The allegedly defective PEX Systems were reportedly installed in more than 2,500 Ocean Pointe homes.
According to the class action lawsuit, the PEX brass plumbing fittings were prone to “dezincify,” causing them to leak and be likely to fail. The plaintiffs also alleged that they were more likely to develop illnesses from toxic mold and metal contamination caused by the faulty pipes.
Several class action lawsuits were also filed regarding the alleged hurricane strap defect. According to these plaintiffs, the metal hurricane straps place in the foundations of Ocean Pointe homes were corroding and may not be able to withstand strong winds.
The defendants deny the allegations but agreed to settle the class action lawsuits to avoid the expense and uncertainty of ongoing litigation.
The final cutoff to submit a verification form for the class action settlements is July 12, 2016. If you do not submit a verification form by this date, you will waive your right to receive payment.
Who’s Eligible
Three Settlement Classes have been certified: the PEX Class, the Hurricane Straps Class, and the Hurricane Straps Repose Subclass.
PEX Class: Includes all homeowners who own homes constructed with brass plumb fittings in their crosslinked polyethylene water distribution systems (PEX Systems) in the Ocean Pointe Project, District of Ewa.
Hurricane Straps Class: Includes all homeowners who own homes constructed with Hurricane Straps in the Ocean Pointe Project, District of Ewa, built on or after Nov. 18, 1999.
Hurricane Straps Repose Subclass: Includes all homeowners who own homes constructed with Hurricane Straps in the Ocean Pointe Project, District of Ewa, built before Nov. 18, 1999.
Potential Award
Members of the PEX Class may qualify for a $2,000 payment.
Members of the Hurricane Straps Class may qualify for repairs to homes that contain the “L” shaped hurricane straps.
Members of the Hurricane Straps Repose Subclass may be eligible for a $5,000 payment.
Proof of Purchase
Class Members who wish to receive benefits from the class action settlement must submit a verification form by July 12, 2016.
