employment Background Check

Infinity Staffing Solutions LLC d/b/a Lyneer Staffing Solutions has agreed to settle a class action lawsuit alleging it violated the Fair Credit Reporting Act with regard to background checks it obtained on job applicants. If Infinity Staffing Solutions or Lyneer Staffing Solutions obtained a background screening report about you for employment purposes from Dec. 6, 2011 through Aug. 21, 2015, you may be entitled to benefits from the class action settlement.

The background check class action lawsuit was filed by plaintiff John Giddiens on behalf of consumers who applied for jobs with Infinity Staffing Solutions and Lyneer Staffing Solutions.

Giddiens alleges the companies violated FCRA by embedding a release and waiver of rights in the consent and disclosure document they require job applicants to sign prior to ordering a background check, and that they improperly used the background checks to make adverse employment decisions without providing the job applicant with a copy of the report and other information required under FCRA.

The defendants deny any wrongdoing but agreed to settle the class action to avoid the distraction, risk and expense of ongoing litigation.

Who’s Eligible

If you belong to either of the following two Classes, you are eligible for benefits from the background check settlement.

B(b)(2) Class:

The B(b)(2) Class includes: “All individuals about whom the Defendant obtained a background check for employment purposes using its standardized form titled ‘Authorization for Release of Information,’” from Dec. 6, 2011 through Aug. 21, 2015.

B(b)(3) Class:

The B(b)(3) Class includes all individuals who applied for employment with Defendant from Dec. 6, 2011 through Aug. 21, 2015, and:

  • For whom Defendant obtained a consumer report for employment purposes which contained potentially negative information;
  • Were subject to an adverse employment action by Infinity (such as a job denial or not being placed at a particular job); and
  • Defendant did not provide a copy of the consumer report or a written summary of rights under the FCRA prior to the adverse action.
Potential Award

$110 or $1,000.

B(b)(2) Class Members will automatically receive a check for $110.

B(b)(3) Class Members will automatically receive a check for $1,000.

Claim Form Deadline

N/A. Class Members who do not request exclusion from the FCRA class action settlement will automatically receive benefits.

NOTE: The exclusion request must be received by the Settlement Administrator by Nov. 27, 2015.
